Resolution Amending Agreement for Services with the Law Firm of Farella Braun & Martel for Services in Connection with the San Mateo County Health Center

 

Recommendation:

Adopt a resolution authorizing and directing the County Counsel to enter into an amended agreement for services with the law firm of Farella Braun & Martel for litigation services in connection with the reconstruction of the San Mateo County Health Center.

 

Background:

In 1999, the County entered into an agreement with the law firm of Farella Braun & Martel to handle litigation with respect to the reconstruction of the San Mateo County Health Center. The lawsuit involved a claim that a change in size entitled the architect and mechanical design engineer to additional fees. During the course of the litigation, Farella's services expanded to handle a claim by the mechanical contractor for Phase II of the project. The current amendment would increase the maximum payable under the contract from $1,750,000 to $2,150,000. The case has been settled, and it is anticipated that the contract will soon be closed out.

 

Fiscal Impact:

The contract will be paid with funds from the capital projects fund established for the project. There would be no impact to the general fund.
