Agreement with the State Employment Development Department to Provide Wage and Employment History Data

 

Recommendation

Adopt a resolution entering into a three-year agreement from July 1, 2003 through June 30, 2006 with the State Employment Development Department (EDD) to provide Revenue Services with wage and employment history data on debtors to the County.

 

Background

The County provides collection services for a variety of County departments. The Division relies on a number of external sources of information on debtors to assist in the collection effort. The County has contracted with EDD for 14 years to provide employment information on County debtors.

 

Discussion

Sections 1095 (e) and (i) of the California Unemployment Insurance Code allow County agencies to obtain wage and employment history information from EDD in order to collect costs of County provided services.

The agreement will assist Revenue Services in recovering costs by providing additional information on debtors to the County. EDD is the only provider of this information.

This agreement will extend for three years an agreement currently in place to provide this service.

In reviewing the contract from the State, we observed that their non-discrimination clause does not speak to discrimination due to a person's sexual orientation. We contacted our EDD representative, Cindi Teel, and asked if they would allow any changes or amendments to their contract language. We were informed that the State Attorney's office would not approve changes to the language. We understand that the State non-discrimination language is not consistent with the County standard; however, this information is used only to assist with the collection efforts of the Revenue Services Division.

Fiscal Impact

The contract cost is $31 per 1,000 inquires. The maximum amount of this agreement is $5,500 which is available in the Division's budget.
