Recommendation |
Adopt a Resolution to: |
1. |
Waive the Request for Proposal (RFP) process; and |
|
2. |
Authorize the execution of a Second Amendment to the Agreement with Sybase, Inc., increasing the amount by $42,810 to continue software support services for an additional year, and extending the term to June 30, 2004. |

Background |
In September 2001 an Agreement was approved for software support services in the amount of $40,000. In June 2002, Change Order Number 1 was approved, increasing the Agreement amount by $59,394 and extending the term to June 30, 2003 to upgrade software and continue support services. |

Discussion |
Ongoing maintenance of this software is only available through the Sybase vendor, making it necessary to continue our contract with them as a sole-source provider. A Request for Proposal Waiver is included in the Board Resolution. |

County Counsel has approved this Second Amendment as to form, and Risk Management has approved the evidence of insurance. |

Vision Alignment |
This Second Amendment to the Agreement with Sybase, Inc. keeps the commitment of: Responsive, effective and collaborative government and goal number 21: County employees understand, support and integrate the County vision and goals into their delivery of services. This Second Amendment contributes to these commitments and goals since Sybase, Inc. provides system support to ensure optimal performance of the Human Services Agency computer network. |

Fiscal Impact |
This Second Amendment with Sybase, Inc. extends the term of the Agreement to June 30, 2004 and increases the Agreement amount by $42,810, for a total of $142,204. This amount will be cost-applied to other program units where it will be claimed against various funding sources. The Net County Cost for FY 2003-04 is estimated to be $12,843. The appropriation and Net County Cost have been included in the Recommended Budget for FY 2003-04. |
