SUBJECT:

County-Wide Mitigation Fees for County Public Road Reconstruction

 

Recommendation

Adopt a resolution:

 

a)

accepting the report on the status of the County-wide mitigation fees; and

 

b)

finding that fees held over five years are necessary for the reconstruction of County roads and drainage facilities in the areas of benefit where the fees were collected.

 

Previous Board Action

Adopted an ordinance and subsequent amendments to the ordinance authorizing the collection of County-wide mitigation fees to finance County public road and drainage facility reconstruction.

 

Key Facts

The enabling legislation and the ordinance establishing the fees requires that a report be prepared each year on the status of the fees.

The enabling legislation also requires that findings be made on fees held over five years that have not been expended.

 

Discussion

The attached summary indicates the amount of funds that have been collected together with interest from inception of the fees in January 1991 through December 31, 2002
(Exhibit "A").

 

Funds collected in the Mid-Peninsula Area (Burlingame Hills/Devonshire/San Mateo Highlands) amounting to $15,064; in the South Bayside Area (Harbor Industrial, North Fair Oaks, Menlo Oaks) amounting to $111,481; in the Mid-Coast Urban Area (Montara, Moss Beach, El Granada, Princeton) amounting to $58,789.67; and in the Rural Area (Pescadero, San Gregorio, etc.) amounting to $65,328.38, are over five years old and have not yet been used to finance roadway or drainage facility improvement projects.

 

The San Mateo Highlands resurfacing project (Mid-Peninsula), the North Fair Oaks resurfacing project (South Bayside), the El Granada resurfacing project (Mid-Coast Urban), and the Bean Hollow Road Resurfacing Project (Rural) are or will be completed this fiscal year with the expenditures being charged to the appropriate areas of benefit in the Mitigation Fee Fund.

 

We believe that it is appropriate to retain the balance of these funds as there is a need to reconstruct road and drainage facilities in these areas, and the expenditure of these "aged" funds has been delayed for valid reasons. Therefore, we are recommending that your Board determine that these funds will be retained to finance road and drainage reconstruction projects.

 

Vision Alignment

We believe our recommendation is consistent with the Shared Commitment to "ensure the basic health and safety for all" and Goal Number 7, "maintain and enhance the public safety of all residents and visitors" as the mitigation fees are used to reconstruct road and drainage facilities that are used by both residents as well as the general public.

 

Fiscal Impact

There is no impact on the General Fund.

 

The projects as described above and future projects may be financed in part through the use of Road Funds and Mitigation Fees. Future projects will be recommended for budgeting through the normal budget process.

 

A form of resolution has been approved by County Counsel.
