Resolution Authorizing the President of the Board of Supervisors to Execute Amendments to Agreements with Gordon Avenue Property Owners - Collection of Streetlight Operation and Maintenance Fees on the Property Owners' Property Tax Bill

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, property owners on Gordon Avenue executed individual agreements with the County that provide for the installation, operation and maintenance of eight streetlights on Gordon Avenue; and

WHEREAS, said agreements provided that the County would annually bill the Gordon Avenue property owners for the cost of operating and maintaining the eight street lights; and

WHEREAS, the Director of Public Works has recommended that said agreements be amended to allow said costs to be collected on the property owners' tax bill in lieu of annual invoicing; and

WHEREAS, there has been presented to this Board a form of amendment to said agreements that provides that said costs will be collected together with the property taxes; and

WHEREAS, this Board has considered said amendment and the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

The President of this Board of Supervisors is hereby authorized and directed to execute said amendments to the agreements with Gordon Avenue property owners for the installation, operation and maintenance of eight (8) streetlights, and the Clerk of this Board shall attest to the President's signature thereto.

2.

The Director of Public Works is directed to continue to annually invoice property owners that have not executed said amendment, for the proportionate cost to operating and maintaining said lights, including an $15 per year administrative fee, as billing and processing payments is a cost of providing for the operation and maintenance of said lights.
