Adopt Resolution Ordering the Transfer of Territory from the San Mateo-Foster City School District to the Hillsborough City School District

 

Recommendation

Adopt a resolution ordering the reorganization of the San Mateo-Foster City School District and the Hillsborough City School District by transferring certain territory that includes parcels, all or part of which are within the boundary of the San Mateo-Foster City School District, to the Hillsborough City School District, and authorizing the Clerk of the Board of Supervisors to enter the order in the County=s Record of Districts and to prepare and file the necessary papers with the State Board of Equalization.

 

Background

On May 6, 2003, the San Mateo County Committee on School District Organization approved the transfer of approximately three (3) acres of physical property, which are described as lots one through five of Yew Street at Clydsdale Drive, Hillsborough, from the San Mateo-Foster City School District to the Hillsborough City School District. Lots one through four was divided between the two districts and lot five was situated entirely within the San Mateo-Foster City School District. Pursuant to Education Code section 35709, subdivision (b)(1), no election was required, as the territory is currently uninhabited, the owner of the property petitioned for the transfer, and neither school district governing board opposed or objected to the transfer.

 

Discussion

Once the County Committee on School District Organization approves a transfer and if an election is not required, the Board of Supervisors is to issue an order to reestablish the boundaries of the districts affected by the transfer in accordance with Education Code section 35765. It is therefore requested that the Board issue such an order and that the Board authorize the Clerk of the Board to enter the order in the County=s Record of Districts, and that the Clerk prepare and file the necessary papers with the State Board of Equalization. (Education Code section 35765 and Government Code section 54900-54902.) It is further requested that the Order be sent to the Superintendent of Public Instruction, County Assessor, County Controller, County Tax Collector-Treasurer, County Public Works Department, San Mateo-Foster City School District, Hillsborough City School District, County Superintendent of Schools, County Committee on School District Organization and the State Board of Education.
