RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SHELTER NETWORK OF SAN MATEO COUNTY TO PROVIDE EMERGENCY AND TRANSITIONAL HOUSING FOR HOMELESS FAMILIES AND INDIVIDUALS AND AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED $25,000 PER FUNDING SOURCE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, pursuant to Section 570.201 of Title 24 of the Code of Federal Regulations, regarding the Community Development Block Grant (CDBG) Program, grant assistance may be used to fund eligible activities to be carried out by private nonprofit entities duly organized to undertake community development activities or by public agencies; and

WHEREAS, on May 6, 2003, the Board of Supervisors approved the CDBG funding for FY 2003-04, which included funding for this activity; and

WHEREAS, Shelter Network of San Mateo County, Inc., is a duly organized community based non-profit corporation in the State of California; and

WHEREAS, the best interest of the County of San Mateo would be served by waiver of the Request for Proposal, in that in FY 2001-02 the County conducted a formal Request for Proposal for the administration and coordination of a Transitional Housing for Families with Special Needs Program and Shelter Network was the only organization that responded; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an Agreement between the County of San Mateo and Shelter Network of San Mateo County for Provision of Homeless Shelter operations for the period fiscal 2003-04, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the RFP process is waived and the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

IT IS FURTHER RESOLVED, that the Director of the Human Services Agency shall be authorized to execute subsequent amendments and modifications to this Agreement during the term of the Agreement, provided however, that such authority is limited to (a) reducing or increasing the County’s maximum fiscal obligation in the event that there is a commensurate reduction or increase in funding received by the County, provided, however, that such increases shall be limited to a total of $25,000 per funding source; and (b) making changes in the types of services and activities provided by Contractor, provided that the changes have no impact on the County’s maximum fiscal obligation to the Contractor.
