RESOLUTION REVISING THE CLERK OF THE BOARD FEE SCHEDULE |

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that |
|
WHEREAS, Government Code §§6250 and 6253 provide that any writing containing information relating to the conduct of the public's business prepared, owned, used, or retained by any local agency is a public record, and that except for those public records exempt from disclosure by express provisions of law, each local agency, upon a request for a copy of records that reasonably describes an identifiable record or records, shall make the records promptly available to any person upon payment of fees covering direct costs of duplication, or a statutory fee if applicable; and |

WHEREAS, Government Code § 54954.1 provides that any person may request that a copy of the agenda, or a copy of all the documents constituting the agenda packet, of any meeting of a legislative body be mailed to that person. The legislative body may establish a fee for mailing the agenda or agenda packet, which fee shall not exceed the cost of providing the service; and |

WHEREAS, San Mateo County Ordinance Code § 2.136.030 provides that the Clerk of the Board of Supervisors shall perform those duties prescribed by general law, by the Charter, and by ordinances of the Board of Supervisors, for the County Clerk as ex-officio Clerk of the Board of Supervisors; and |
|
WHEREAS, Government Code § 26833 provides that the fee for certifying to a copy of any paper, record, or proceeding is one dollar and seventy-five cents ($1.75); and |
|
WHEREAS, Government Code § 26837 provides that the fee for comparing with the original the copy of any paper, record, or proceeding prepared by another and presented for his certificate, the fee is fifty cents ($0.50) a page, in addition to the fee for his certificate; and |
|
WHEREAS, the Clerk of the Board of Supervisors occasionally provides the service of searching for records, although she is not legally required to do so, and the Board of Supervisors wishes to establish a fee for that optional service; and |
|
WHEREAS, on October 11, 1994, this board has adopted Resolution No. 58749, setting the fee for copying county documents at $.10 per page; and |
|
WHEREAS, the fees being charged by the Clerk of the Board of Supervisors have not been adjusted for a period of time, and therefore do not reflect the present cost of the services provided to the public; and |
|
WHEREAS, the Clerk of the Board has proposed the following fee schedule, which appears to be consistent with applicable legal mandates. |
|
NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the following revised fee schedule for services provided by the Clerk of the Board of Supervisors hereby adopted and approved: |
