RESOLUTION AUTHORIZING ACCEPTANCE OF A GRANT DEED FROM

THE COMMUNITY ASSOCIATION FOR REHABILITATION, INC. FOR THE

REAL PROPERTY COMMONLY KNOWN AS

2101 OAKLEY AVENUE, MENLO PARK, CALIFORNIA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, in 1982, this Board adopted Resolution No. 43569, which authorized the County of San Mateo to enter into a Development Agreement ("Agreement") with the Community Association for Retarded, Inc. ("CAR") to sell to CAR, for the development and operation of new rental housing for low and moderate income developmentally disabled adults, that certain real property commonly known as 2101 Oakley Avenue, Menlo Park, California ("Property"); and

WHEREAS, Resolution No. 43589 authorized the execution of a Grant Deed conditionally granting the Property to CAR, provideded that title to the Property reverts to the County if CAR fails to use the Property for the purposes specified in the Agreement and

WHEREAS, the Community Association for Rehabilitation, Inc., successor in interest to CAR, has elected to discontinue using the property as a residence for developmentally disabled adults; and

WHEREAS, the Board of Directors for the Community Association of Rehabilitation, Inc. has adopted a resolution authorizing transfer of the Property back to the County of San Mateo by grant deed; and

WHEREAS, the State of California is the beneficiary of a note secured by deed of trust on the Property in the sum of $124,290; and

WHEREAS, the value of the property, appraised by the Real Property Division at $850,000, greatly exceeds the indebtedness reflected in such note and deed of trust, and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Grant Deed, reference to which is hereby made for further particulars, whereby the Community Association for Rehabilitation grants to the County of San Mateo fee simple interest in the Property.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED AS FOLLOWS:

That the President of this Board of Supervisors be, and is hereby, authorized and directed to accept said Grant Deed subject to said note and deed of trust held by the State of California, and shall execute a Certificate of Acceptance, and all necessary documents in connection with said transfer, for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest to the President's signature thereto.
