BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION REJECTING THE ONE BID RECEIVED FOR ACCESSIBILITY UPGRADES AND RENOVATIONS AT FOUR COUNTY FACILITIES AND AUTHORIZING THE USE OF COUNTY FORCES TO CONSTRUCT SAID UPGRADES AND RENOVATIONS
(PROJECTS NO. P2T10, P2T11, P2T12, P2T13)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors did, on April 22, 2003, adopt Resolution No. 065951, which resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for sealed bids for the Accessibility Upgrades and renovations at four County Facilities, and

 

WHEREAS, the Clerk of this Board of Supervisors did, in public on May 20, 2003, open and examine the one sealed proposal that was received in the specified time for the doing of the work referred to in said Resolution No. 065951; and

 

WHEREAS, the bid of John Plane Construction, Inc., in the amount of Five Hundred Twenty-Seven Thousand Nine Hundred Seventy-Nine and No/100 Dollars ($527,979.00) was the one bid received for doing said work; and

 

WHEREAS, this Board of Supervisors has caused an analysis of said sealed proposal to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said proposal and the analysis thereof; and

WHEREAS, the one bid received is $157,979 over the engineer's estimate of $370,000; and

 

WHEREAS, Section 22038 of the State of California Public Contract Code provides that a public agency may reject any bid submitted and may, by 4/5ths vote of its governing body, declare that a project may be done more economically by the employees of the public agency; and

 

WHEREAS, the Director of Public Works has determined that the aforesaid work can be constructed more economically by Public Works' staff; and

 

WHEREAS, this Board has considered the determination made by the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

the one bid received from John Plane Construction Inc., 833 Mahler Road, Suite 18, Burlingame, CA 94010, for Accessibility Upgrades and Renovations at Four County Facilities is hereby rejected;

 

2.

the project can be performed more economically by the employees of the Public Works Department, and this Board hereby authorizes the Director of Public Works to have the aforesaid work done by force account; and

   

3.

the Director of Public Works is hereby authorized to pay for said work with funds appropriated for doing said work.
