Background
|
On March 25, 2003, the Board of Supervisors adopted an ordinance adding section 5.92.055 to the San Mateo County Ordinance Code, requiring that mobilehome parks obtain an annual business license to operate.

The County’s License Board held a public hearing on the license application of the El Granada Manufactured Home Community on June 9, 2003, and issued its decision to grant the license with conditions on June 12, 2003. Various parties filed appeals, and your Board held a hearing on the appeals on July 15, 2003. At that time, your Board continued the hearing to August 12, 2003 and asked that the applicant submit additional information.

In the meantime, after a hearing on July 25, 2003, Judge Thomas McGinn Smith of the San Mateo County Superior Court issued an injunction barring the County from enforcing the mobilehome license ordinance while the lawsuit, Trailer Rancho Associates v. County of San Mateo, is pending.

Discussion
|
In light of the court’s order, it is our recommendation that the hearing on the appeal of this matter be continued. The date of the hearing would be determined later, after a further ruling by the court on the validity of the ordinance.
