RESOLUTION AUTHORIZING THE IMPOSITION OF PROBATION DEPARTMENT AMINISTRATIVE FEES FOR A PETITON TO CHANGE A PLEA OR SET ASIDE A VERDICT PER SECTION 1203.4 OF THE PENAL CODE AND TO SEAL A RECORD PER SECTIONS 1203.45 OF THE PENAL CODE AND SECTION 903.3 OF THE WELFARE AND INSTITUTIONS CODE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Penal Code Section 1203.4, under certain conditions, permits a petition to the Court under this section to change a plea to not guilty or set aside a guilty verdict; and

WHEREAS, Penal Code Section 1203.45 and Welfare and Institutions Code Section 903.3, under certain conditions, permit a petition to the Court under these sections to seal the record of conviction and other official records in the case;

WHEREAS, persons petitioning under these sections may be required to reimburse the County for actual cost of services rendered, whether or not the petition is granted, at a rate determined by the County Board of Supervisors, not to exceed one hundred and twenty dollars ($120) provided the Court approves such payment based on petitioner’s ability to pay;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors of San Mateo County establishes, and authorizes the Probation Department to seek from petitioners a one-time fee of one hundred dollars ($100) for reimbursement for changing a plea or setting aside a verdict pursuant to Penal Code section 1203.4 and sealing a record pursuant to Penal Code section 1203.45 and section 903.3 of the Welfare and Institutions code.
