RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE CITY OF REDWOOD CITY AND THE REDWOOD CITY SCHOOL DISTRICT FOR RENOVATION AND MAINTENANCE OF THE FAIR OAKS SCHOOL PLAYFIELD AND AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED $25,000 PER FUNDING SOURCE |

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that |
|
WHEREAS, the Redwood City School District ("District") is the owner of certain real property, also known as the Fair Oaks Elementary School, located at 2950 Fair Oaks Avenue, Unincorporated Redwood City ("Property"); and |
|
WHEREAS, the District, the City of Redwood City ("City"), and the County have determined that the Playfield ("Playfield") at the Property has joint benefit for all Parties, in that the Playfield would be maintained for school activities during school hours, and for community-wide recreational use during off-school hours in order to maximally benefit neighborhood residents, particularly youth; and |

WHEREAS, the Parties desire to cooperate to repair and renovate the Playfield ("Project"), and to have it maintained after renovation; and |
|
WHEREAS, the Project is estimated to cost $1.214 million, including architectural services and contingencies; and |
|
WHEREAS, a total of $1.214 million has been committed to the Project as described below; and |
|
WHEREAS, the City, on behalf of itself and the District, applied to the County for Community Development Block Grant ("CDBG") funding assistance for the Project; and on May 6, 2003, the County Board of Supervisors approved the CDBG Action Plan for FY 2003-04, which included $300,000 CDBG funding for the Project; and |
|
WHEREAS, on February 24, 2003, the City Council approved $525,000 for the Project; and the City intends to set aside another $100,000 for this Project, resulting in a total City commitment of $625,000; and |
|
WHEREAS, the District approved $289,000 for this Project from proceeds of a school bond for playfield renovation; and |
|
WHEREAS, the above-named Parties desire to enter into an Agreement for the purposes of repair, renovation, and maintenance of the Playfield; |
|
NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo; and the Clerk of this Board shall attest the President's signature thereto. |

BE IT FURTHER RESOLVED, that the Director of the Human Services Agency shall be authorized to execute subsequent amendments and modifications to this Agreement during the term of the Agreement, provided however, that such authority is limited to (a) reducing or increasing the County's maximum fiscal obligation in the event that there is a commensurate reduction or increase in funding received by the County, provided, however, that such increases shall be limited to a total of $25,000 per funding source; and (b) making changes in the types of services and activities provided by the City and the District, provided that the changes have no impact on the County's maximum fiscal obligation to the City. |
