Resolution Authorizing an Increase in the Aggregate Payment to the Contractor for the Coyote Point Marina 2003 Maintenance Dredging Project

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors adopted Resolution No. 065970 on May 6, 2003, awarding a contract to Dutra Construction Company (Contractor) for a Not-to-Exceed amount of One Million Eighty-One Thousand and No/100 Dollars ($1,081,000.00) for the Coyote Point Marina 2003 Maintenance Dredging Project (Project); and

WHEREAS, County entered into an Agreement with Dutra Construction Company as authorized by said resolution; and

WHEREAS, the Parks and Recreation Division of the Environmental Services Agency has requested that additional dredging be done as part of the Project to insure access to Marina facilities by large recreational boats; and

WHEREAS, the Contractor has provided an estimate for doing said additional dredging; and

WHEREAS, the Director of Public Works has reviewed said estimate and believes that it represents a fair cost of doing the work as contemplated; and

WHEREAS, it is anticipated that the cost of the estimated work in addition to other work as proposed in the Marina will increase the construction cost to an amount greater than was originally authorized by this Board; and

WHEREAS, the Director of the Parks Division of the Environmental Services Agency and the Director of the Environmental Services Agency have recommended that the work be done and this Board has considered their recommendation.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

1.

the agreement with Dutra Construction Company, authorized by this Board on May 6, 2003, is hereby amended to provide that aggregate payments to Dutra Construction Company for said work shall not exceed the sum of One Million One Hundred and Thirty-One Thousand and No/100 Dollars ($1,131,000.00) without this Board's approval;

2.

with the exception of the modification as herein provided, the agreement with Dutra Construction Company, authorized by this Board on May 6, 2003, shall remain unchanged.
