County Counsel

DATE:

October 6, 2003

BOARD MEETING DATE:

October 21, 2003

TO:

Honorable Board of Supervisors

FROM:

Thomas F. Casey III, County Counsel

SUBJECT:

Adopt Resolution Amending Resolution 65302 Ordering the Transfer of Territory from the La Honda-Pescadero Unified School District to the Portola Valley Elementary School District and the Sequoia Union High School District

Recommendation

Adopt a resolution amending Resolution 65302 to correct a clerical error and the omission of reference to Sequoia Union High School District. Resolution 65302 currently orders the reorganization of the La Honda-Pescadero Unified School District and the Portola Valley Elementary School District by transferring certain territory within the boundary of the La Honda-Pescadero Unified School District to the Portola Valley Elementary School District, and authorizes the Clerk of the Board of Supervisors to enter the order in the County's Record of Districts and to prepare and file the necessary papers with the State Board of Equalization.

Background

On November 28, 2000, the San Mateo County Committee on School District Organization (CCSDO) approved the transfer of forty-two (42) acres of physical property at 211 Rapley Ranch Road, La Honda from the La Honda-Pescadero Unified School District to the Portola Valley Elementary School District and the Sequoia Union High School District. Pursuant to Education Code section 35709, no election was required.

On June 4, 2002, the Board of Supervisors ratified the CCSDO's decision by adopting Resolution 65302. Reference to Sequoia Union High School District was omitted and on page two of said resolution, a clerical error appeared. Namely, "Belmont/Redwood Shores" appeared in the place of "La Honda/Pescadero" and "San Carlos" appeared in the place of "Portola Valley."

Discussion

Once the County Committee on School District Organization approves a transfer and if an election is not required, the Board of Supervisors is to issue an order to re-establish the boundaries of the districts affected by the transfer in accordance with Education Code section 35765. The Board issued such an order pursuant to Resolution 65302 and authorized the Clerk of the Board to enter the order in the County's Record of Districts, and that the Clerk prepare and file the necessary papers with the State Board of Equalization. (Education Code section 35765 and Government Code section 54900-54902.)

Upon adopting a resolution amending Resolution 65302, it is requested that the Board authorize the Clerk of the Board to forward said Resolution to the State Board of Equalization and enter the order in the County's Record of Districts. It is also requested that the Clerk of the Board also cause the amended Resolution to be sent to the Superintendent of Public Instruction, County Assessor, County Controller, County Tax Collector-Treasurer, County Public Works Department, La Honda-Pescadero Unified School District, Portola Valley Elementary School District, Sequoia Union High School District, County Superintendent of Schools, County Committee on School District Organization and the State Board of Education.
