RESOLUTION 1) AUTHORIZING THE EPS DIRECTOR TO SIGN A CONTRACT WITH BENEFITONE FOR THE PERIOD FROM JANUARY 1, 2004 THROUGH DECEMBER 31, 2008 FOR ADMINISTRATIVE SERVICES FOR THE COUNTY'S HEALTH CARE FLEXIBLE SPENDING ACCOUNT UPON APPROVAL BY COUNTY COUNSEL, 2) CREATING AN INTEREST-BEARING FSA ACCOUNT WITHIN THE BENEFITS TRUST FUND, 3) AUTHORIZING THE ANNUAL TRANSFER FOR FICA SAVINGS TO THE FSA TRUST FUND ACCOUNT, 4) AUTHORIZING PAYMENT FROM THE FSA TRUST FUND TO BENEFITONE FOR REIMBURSEMENT OF ELIGIBLE HEALTH CARE EXPENSES AND ADMINISTRATIVE SERVICES AND 5) AUTHORIZING THE EMPLOYEE AND PUBLIC SERVICES DIRECTOR TO SIGN A FORMAL PLAN DOCUMENT COMPLYING WITH FEDERAL PROVISIONS FOR THIS TYPE OF PLAN UPON APPROVAL BY COUNSEL.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County has agreed in negotiations with its labor organizations to implement a Health Care Flexible Spending Account; and

 

WHEREAS, a Labor-Management Committee has reviewed responses to a Request for Proposal of services and has unanimously recommended the selection of BenefitOne to provide administrative services; and

 

WHEREAS, the Committee has also recommended that an interest-bearing Trust Fund be established and that FICA savings be deposited into the Trust Fund from which eligible health care expenses will be reimbursed; and

 

WHEREAS, a formal plan document must be signed complying with federal provisions for this type of plan;

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President and this Board of Supervisors hereby authorizes: 1) the EPS Director to sign an agreement with BenefitOne, 2) the creation of an interest-bearing Trust Fund Account within the Benefits trust fund and annual contributions of FICA Savings into the Trust Fund 3) the payment from the Trust Fund to BenefitOne for reimbursement of eligible health care expenses and 4) the EPS Director to sign the formal plan document complying with federal provisions for this type of plan upon Counsel approval.
