Contract between County of San Mateo and Local Agency Formation Commission for Staff Services, Office Space and Legal Counsel

 

RECOMMENDATION

 

Adopt the resolution authorizing execution of an agreement with the San Mateo Local Agency Formation Commission (LAFCo) under which the County would provide management and administrative support services to LAFCo from July 1, 2003 through June 30, 2004.

 

BACKGROUND

 

The Cortese Knox Hertzberg Act of 2000 (CKH Act) authorizes LAFCo to contract with the County or another public agency for staffing, office space and legal counsel. The CKH Act also requires that LAFCo adopt an operating budget and that funding of the operating budget less application revenues be apportioned in thirds to the County, cities and independent special districts. Since 1996, San Mateo LAFCo has contracted with the County of San Mateo for Executive Officer, legal counsel, office space and related services.

 

DISCUSSION

 

At the September 17, 2003 meeting, the Commission adopted an appropriations budget of $201,542 of which $18,340 is reserve and $13,000 is consulting fees (5856). The net amount $170,202 includes salaries and benefits, office space, supplies, legal counsel and contract administration through the Environmental Services Agency.

 

VISION ALIGNMENT

 

The contract for provision of services to LAFCo keeps the commitment of responsive, effective and collaborative government and goal number 22: County and local governments effectively communicate, collaborate and develop strategic approaches to issues affecting the entire County. The contract for provision of services to LAFCo contributes to this commitment and goal by providing cost-efficient services to the Commission that consists of County, city, special district and public representation.

 

FISCAL IMPACT

 

The contract amount provides for cost recovery of County services provided to the Commission. Because Government Code Section 56381 requires that the LAFCo budget, less estimated application fees, be apportioned to the County, cities and independent special districts, the proposed agreement results in a net County cost of $40,698 as originally adopted by the Commission and included in the recommended County budget.
