Agreement to Reinstate Development Rights for Real Property located in Unincorporated Emerald Lake Hills

 

Recommendation

Adopt a resolution authorizing the President of the Board of Supervisors to execute an Agreement to Reinstate Development Rights for Real Property owned by Sean and Chantellie Kent in unincorporated Emerald Lake Hills.

 

Background

In 1984, the owner of Assessor Parcel 057-221-140 relinquished to the County certain development rights in relation to the construction and/or placement of any and all structures intended to be utilized as living units which require water and/or sewer connections, in exchange for release from assessment for a sewer connection.

The new owners, Sean and Chantellie Kent have requested the reinstatement of development rights at the property.

 

Discussions

The Director of Public Works has agreed to reinstate the development rights at the property in exchange for inclusion of the property in the Emerald Lake Hills Wastewater Management Assessment District and payment of all requisite fees and assessments. Mr. and Mrs. Kent have also paid a $1,500 processing fee to cover all costs associated with preparing this agreement. The Director of Public Works concurs with our recommendation. County Counsel has reviewed the agreement as to form.

based on careful consideration of future impact, rather than temporary gain. The agreement

contributes to this commitment and goal by reinstating development rights to the property owners.
