Resolution Authorizing Execution of an Agreement for the Installation of a Retaining Wall and Drainage Facilities - Land of Casey

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Mel Casey and Marguerite N. Casey (the Caseys) are the owners of real property in the County of San Mateo, State of California, and have requested the issuance of an Encroachment Permit from the County to install a retaining wall and drainage facilities (encroachments) in the Greendale Way right-of-way; and

WHEREAS, the Caseys have agreed to execute a recorded agreement to maintain, repair, relocate or remove said encroachments at their expense upon demand of County; and

WHEREAS, the Director of Public Works has recommended that said agreement be approved and this Board has considered the recommendation of the Director of Public Works.

NOW, THEREFORE, BE IT RESOLVED, that said Agreement by and between the County of San Mateo and Mel and Marguerite N. Casey is hereby approved, and the President of the Board of Supervisors is hereby, authorized to execute said agreement for and on behalf of the County of San Mateo.
