RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDMENT TO TWO AGREEMENTS WITH THE CITY OF DALY CITY, AND AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED $25,000 PER FUNDING SOURCE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the San Mateo HOME Consortium was established in the early 90s for qualified jurisdictions in the County to access HOME funds more efficiently; and

 

WHEREAS, the City of Daly City has participated in the San Mateo County HOME Consortium since its inception, but decided to leave the Consortium as of the end of FY 2002-03; and

 

WHEREAS, the HOME Consortium Cooperation Agreement with the Contractor, dated June 1, 1999, by Resolution No. 62844 ("Cooperation Agreement), enumerated terms and conditions of HOME funding to the Contractor through the FY 2002-03 cycle; and

 

WHEREAS, the Contractor has a total HOME remaining balance of $546,587 as of June 30, 2003 ($258,792 plus $287,795); and

 

WHEREAS, the above balance resulted from allocations covered by two separate funding Agreements, executed April 4, 2000 and October 22, 2002, approved respectively by Resolution Nos. 63518 and 65632 ("Funding Agreements") and which both have incorporated the Cooperation Agreement by reference; and

 

WHEREAS, the remaining balance of $546,587 comprise respective balances of $258,792 plus $287,795 from the two funding agreements; and

 

WHEREAS, the Cooperation Agreement specifically provided that the contract term "shall remain in effect until the HOME funds from each of the Federal fiscal years are closed out pursuant to Federal regulation 24 CFR 92.505"; and

 

WHEREAS, the Cooperation Agreement further provides that the Contractor, upon leaving the HOME Consortium, will no longer be qualified to receive future funding through the HOME Consortium, but may continue to expend HOME funds allocated up through the FY 2002-2003 HOME funding cycle; and

 

WHEREAS, the two Funding Agreements have ostensible termination dates, but which need to be extended to coincide with the close-out of the HOME funds; and

 

WHEREAS, the HOME close-out date provision renders imprecise contract end dates for the Funding Agreements; and

 

WHEREAS, the purpose of the subject Amendments is to consolidate and provide a definitive close-out date for the HOME funds.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said Amendments for and on behalf of the County of San Mateo; and the Clerk of this Board shall attest the President's signature thereto.

 

BE IT FURTHER RESOLVED, that the Director of the Human Services Agency shall be authorized to execute subsequent amendments and modifications to these Agreements during the term of the Agreements, provided however, that such authority is limited to (a) reducing or increasing the County's maximum fiscal obligation in the event that there is a commensurate reduction or increase in funding received by the County, provided, however, that such increases shall be limited to a total of $25,000 per funding source; and (b) making changes in the types of services and activities provided by Contractors, provided that the changes have no impact on the County's maximum fiscal obligation to Contractors.
