Property Tax Exchange - Midpeninsula Regional Open Space District |

RECOMMENDATION: |
|
Approve a resolution authorizing a zero property tax exchange between San Mateo County and the Midpeninsula Regional Open Space District (the "District) for the proposed annexation of the unincorporated portions of the County, currently not included within the District boundaries. |

BACKGROUND: |
|
San Mateo Local Agency Formation Commission (LAFCO) has received an application from the District to annex coastal San Mateo County. San Mateo LAFCo is the lead LAFCo on this project and LAFCo consideration includes referral of the application to Santa Clara LAFCo for comment and recommendation before San Mateo LAFCo takes final action on the application. |

Section 99 of the Revenue and Taxation Code requires that affected agencies enter into negotiations regarding exchange of property tax revenue and that resolutions of property tax exchange must be adopted before LAFCo can schedule an annexation proposal for hearing. In this case, the District has indicated that it will not request a portion of property tax revenues collected in the subject area. |

DISCUSSION: |
|
In order to comply with Revenue and Tax Code, in cases where there is no exchange of property tax revenues because there is no exchange of service responsibility, it is necessary that the agencies adopt a resolution of zero tax exchange before an annexation application can be certified as complete and scheduled for hearing by LAFCo. |

FISCAL IMPACT: |
|
There is no fiscal impact to the County in adopting the zero tax exchange. |
