Resolution Authorizing Execution an Agreement with The Oettinger 1979 Trust, as Amended - Maintenance of the Encroachments within the Public Right-of-Way on Alameda de las Pulgas and Ashton Avenue Fronting the Property at 3500 Alameda de las Pulgas - West Menlo Park Area |

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that |
|
WHEREAS, The Oettinger 1979 Trust, as amended (Permittee) constructed a commercial building at 3500 Alameda de las Pulgas; and |
|
WHEREAS, the Permittee has requested issuance of an Encroachment Permit from the County to install the Encroachments in the public right-of-way fronting the property at 3500 Alameda de las Pulgas; and |
|
WHEREAS, the Director of Public Works has determined that the installation of the Encroachments as proposed by the Permittee will not interfere with the public's use of the right-of-way on Alameda de las Pulgas and Ashton Avenue at this time or in the foreseeable future; and |
|
WHEREAS, the Permittee has executed an agreement with the County to acknowledge the Permittee or their successors in interest are responsible to maintain, repair, relocate, and/or remove said Encroachments upon notification of the County; and |
|
WHEREAS, there has been presented to this Board a form of agreement and this Board has considered same. |
|
NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Agreement on behalf of the County and the signature of the Clerk of this Board shall attest thereto. |
