Under current inclusionary program proposal, in-lieu fee option is only for developments of five to nine units. Developments of ten units or more must provide the affordable lots/units.

Amount of in-lieu fee varies according to the size of the subdivision, with a lesser fee due for smaller subdivisions (e.g., a 5-lot subdivision pays 50% of the cost to provide one affordable unit, a 6-lot subdivision pays 60% of the cost of one affordable unit, etc., up to 90% for a 9-lot subdivision).

Calculation of in-lieu fee based on current (October, 2003) cost of single-family construction and assumed house size of 3,500 sq. ft.
