RESOLUTION WAIVING THE REQUEST FOR PROPOSAL PROCESS AND AUTHORIZING THE EXECUTION OF A SECOND AMENDMENT TO THE O’RORKE, INC., AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, The Board of Supervisors approved an Agreement with O’Rorke Inc., on April 8, 2003, for the purpose of providing tobacco social marketing and media services; and

WHEREAS, this Agreement was Amended to clarify the rate of payment; and

WHEREAS, the Parties wish to further amend the Agreement to increase the amount by $62,328 changing the Agreement obligation from $165,000 to $227,328 and extending the term from June 30, 2004 to June 30, 2005, for the purpose of providing additional media services to: publicize existing tobacco cessation services, educate the public about tobacco control laws and policies, and support the implementation and enforcement of those laws and policies; and

WHEREAS, it is in the County’s best interest to waive the Request for Proposal process so that there are no interruption in services and the funding added to the Agreement needs to be used by June 30, 2004; and

WHEREAS, this Second Amendment to the Agreement has been presented to the Board of Supervisors for its consideration and acceptance, and the Board of Supervisors has examined and approved the Amendment as to both form and content, and desires to enter into the same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said Second Amendment the Agreement for and on behalf of the County of San Mateo; and the Clerk of this Board shall attest the President's signature thereto.

BE IT FURTHER DETERMINED AND ORDERED that the Request for Proposal process is waived.
