AN ORDINANCE ESTABLISHING REGULATIONS FOR THE SHORT TERM RENTAL OF ROOMS (COMMONLY KNOWN AS A BED AND BREAKFAST INN) IN ZONING DISTRICTS OUTSIDE OF THE COASTAL ZONE

 
 

The Board of Supervisors of the County of San Mateo, State of California, ordains as follows:

 

SECTION 1. Section 6102.14.1 is added to Chapter 1, Part I, Division VI (Zoning) of the San Mateo County Ordinance Code, to read as follows:

 

    Section 6102.14.1. BED AND BREAKFAST INN (definition for areas outside Coastal Zone only). The short term (less than 30 days) rental of not more than five (5) guest rooms and/or the providing of table board for guests, in a dwelling or otherwise, but not to the extent of constituting a hotel as defined in this Part, unless permitted in the district. When provided in a dwelling in a residential district, the bed and breakfast use shall be incidental to that of its occupancy as a dwelling of the character permitted in the respective district and shall not alter the character of the premises in respect to their use as a dwelling. See Section 6400.

 

SECTION 2. Section 6241(c)8 is added to Chapter 14, Part I, Division VI (Zoning) of the San Mateo County Ordinance Code (“H-1” Districts), to read as follows:

 

    8. Bed and breakfast inns (outside Coastal Zone only).

 

SECTION 3. Section 6251(a)7 is added to Chapter 15, Part I, Division VI (Zoning) of the San Mateo County Ordinance Code (“C-1” Districts), to read as follows:

 

    7. Bed and breakfast inns (outside Coastal Zone only).

 

SECTION 4. Section 6261(d)9 is added to Chapter 16, Part I, Division VI (Zoning) of the San Mateo County Ordinance Code (“C-2” Districts), to read as follows:

 

    9. Bed and breakfast inns (outside Coastal Zone).

 

SECTION 5. Subdivision (a) of Section 6400 of Chapter 22, Part I, Division VI (Zoning) of the San Mateo County Ordinance Code, is amended to read as follows:

     
 

(a)

Rental of rooms.

       
   

1.

Provisions within the Coastal Zone.

       
     

The renting of rooms and/or the providing of table board in a dwelling as an incidental use to that of its occupancy as a dwelling of the character permitted in the respective district, but not to the extent of constituting a hotel as defined in this Part, unless permitted in the district.

       
   

2.

Provisions outside the Coastal Zone.

       
     

The long term renting of rooms and/or the providing of table board in a dwelling (for a period of 30 consecutive days or longer only) as an incidental use to that of its occupancy as a dwelling of the character permitted in the respective district, but not to the extent of constituting a hotel as defined in this Part, unless permitted in the district. (The short term rental of rooms, for a period less than 30 consecutive days, and bed and breakfast inns are not allowed in “R” Districts outside the Coastal Zone.)

       

SECTION 6. Severability. If any section, subsection, phrase, clause, sentence, or word in this ordinance shall for any reason be held invalid or unconstitutional by a court of competent jurisdiction, it shall not nullify the remainder of this ordinance but shall be confined to the article, section, subsection, subdivision, clause, sentence or word so held invalid or unconstitutional.

       

SECTION 7. Repeal of Interim Ordinance. Ordinance No. 04204 will be of no further force and effect thirty (30) days after the date of adoption of this ordinance, except that any bed and breakfast inn that becomes a legal non-conforming use by virtue of the adoption of this ordinance shall remain subject to the terms of Ordinance No. 4204 unless and until such use is amortized or discontinued as a legal non-confirming use.

       

SECTION 8. This ordinance shall be in full force and effect thirty (30) days after its adoption.
