Resolution (1) Certifying the Final Environmental Impact Report for the San Carlos Airport Master Plan Update - Airport Modernization Project as Complete, Correct, and Adequate and Prepared in Accordance with the California Environmental Quality Act; and (2) Approving the San Carlos Airport Modernization Project List

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that:

 

WHEREAS, the County has prepared the San Carlos Airport Master Plan Update – Airport Modernization Project (Plan) that specifies projects- the San Carlos Airport Modernization Project List- to modernize and upgrade facilities at the airport to meet the safety, reliability and service needs of operations through the year 2015; and

 

WHEREAS, the California Environmental Quality Act (CEQA), the State CEQA Guidelines and the County CEQA Guidelines provide that the County must certify that an environmental impact report (EIR) prepared for a project that may have significant environmental effects has been completed in compliance with CEQA; and

 

WHEREAS, the County prepared an Initial Study of the Plan which determined that it was a project subject to CEQA and concluded that an EIR should be prepared to address the potentially significant environmental impact of the project; and

 

WHEREAS, on February 14, 2001, the County prepared, published and circulated, pursuant to the requirements of CEQA and the State CEQA Guidelines, a Notice of Preparation in order to obtain comments from interested persons and agencies on the proposed scope of the EIR; and

 

WHEREAS, a scoping session was held on March 1, 2001, to solicit public comment on issues to be addressed in the Draft EIR (DEIR); and

 

WHEREAS, on July 2, 2002, the County completed the DEIR and the DEIR was published and distributed to the State Clearinghouse, Federal, State and local agencies and special districts, public libraries, other known interested parties, and was made available to the general public, thereby commencing a 45-day period from July 9, 2002, through August 22, 2002, for public review and comment on the adequacy and contents of the DEIR in accordance with the requirements of CEQA. A Notice of Completion of the DEIR specifying the public review and comment period and hearing date was posted on July 2, 2002, and circulated in accordance with the requirements of CEQA; and

 

WHEREAS, on July 30, 2002, a public meeting was held on the Plan and written and verbal comments on the DEIR were received and were made part of the record on the DEIR; and

 

WHEREAS, other written comments on the DEIR were received by the County during the public review period and were made a part of the record of comments on the DEIR; and

 

WHEREAS, on August 22, 2002, the 45-day public comment period on the DEIR terminated; and

 

WHEREAS, on August 18, 2004, the County published the Final EIR (FEIR) containing all comments received by the County on the DEIR, responses to those comments raising environmental issues and revisions to the DEIR text made thereby; and

 

WHEREAS, the FEIR was made available to the public and distributed in accordance with the requirements of CEQA, and was made available to those public agencies that submitted comments on the DEIR; and

 

WHEREAS, on August 31, 2004, the Board of Supervisors considered the Plan at their regularly scheduled meeting, accepted public testimony concerning the FEIR, and an audio tape transcript was made of the proceedings as part of the record of proceedings concerning the FEIR; and

 

WHEREAS, the County received and the Board of Supervisors has heard, and has been presented with and is familiar with all of the information in the administrative record, has reviewed and considered the information in the DEIR and the FEIR for completeness and compliance with CEQA, the State CEQA Guidelines and the County's CEQA Guidelines, and has independently reviewed and analyzed the FEIR.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED by the San Mateo County Board of Supervisors, based on the foregoing facts and circumstances, and the administrative record concerning the Plan, which includes the public written and oral testimony received on the DEIR and the FEIR, that:

 

Regarding the San Carlos Master Plan Update – Airport Modernization Project Environmental Impact Report:

 

1.

The Plan Final EIR (FEIR) is complete, correct and adequate and prepared in accordance with the California Environmental Quality Act and applicable State and County guidelines.

 

2.

The FEIR consists of the following documents:

 
 

a.

The DEIR.

 
 

b.

The FEIR, which includes (1) revisions to the DEIR made in response to comments, (2) comments received from the public, written and oral, and written responses to public comments, and (3) supplemental responses to public comments.

 

3.

All comments made on the DEIR that raised environmental issues were responded to adequately in the FEIR and in supplemental responses pursuant to the requirements of CEQA, and the FEIR does not contain significant new information requiring additional public review. There have been no changes to the proposed project or its surrounding circumstances or significant new information since the DEIR was completed and circulated for public comment.

 

4.

The FEIR reflects the independent judgment and analysis of San Mateo County.

 

5.

The FEIR has been completed and processed in accordance with the requirements of CEQA, the State CEQA Guidelines, and the County's CEQA Guidelines.

 

6.

The Board has reviewed and considered the FEIR and the environmental effects of the proposed project.

 

7.

On the basis of the FEIR, comments received hereto, and testimony presented and considered at the public hearings on this matter, there is no substantial evidence that the projects specified in the Plan will have a significant effect on the environment.

 

8.

Since the proposed project, as modified, does not have a significant adverse impact on the environment, no mitigation measures are needed, and a Mitigation Monitoring and Reporting Plan is not required under California Public Resources Code Section 21081.6.

 

9.

The Board has reviewed and considered the Proposed Project and the required No Project Alternative as described in the EIR. A range of alternatives were considered in the FEIR but were not carried forward for detailed analysis because (1) they were not consistent with the safety, reliability and service goals and objectives or the planning principles for the Airport, (2) they are not responsive to concerns expressed by the public, (3) they do not reduce the potential environmental impact of the Project, or (4) they were infeasible.

 

10.

The custodian of the documents constituting the record of proceedings is Neil Cullen, Director of Public Works, County of San Mateo, 555 County Center, 5th Floor, Redwood City, CA 94063-1665.

 

11.

The County Manager, or his designee, is directed to file a Notice of Determination and undertake any other documentation necessary as required by CEQA and State and County guidelines.

 

Regarding the San Carlos Airport Modernization Project List(List):

 

1.

The List is approved and contains those projects that can modernize and upgrade Airport facilities to meet the safety, reliability and service needs of San Carlos Airport operations through the year 2015.

 

2.

The Director of Public Works, or his designee, is hereby authorized to develop plans for said projects and to return to this Board for consideration of implementing said projects either individually or collectively, once applicable permits are obtained and funding becomes available to finance the specific work.
