Third Amendment to the Agreement with Martin L. Forst

 

Recommendation

Adopt a resolution authorizing:

 

1.

The waiver of the Request for Proposal Process (RFP); and

 

2.

The execution of a Third Amendment to the Agreement with Martin L. Forst in the amount of $46,500 changing the total obligation from $109,000 to $155,500, and extending the term to June 30, 2007.

 

Background

Martin L. Forst began providing evaluation services for the Tobacco Prevention Program (TPP) in 1997 under an Agreement with Health Services Agency. Mr. Forst assisted in the development of TPP’s workplan, which included a multi-component evaluation design for several of the TPP objectives. TPP was moved to the Human Services Agency on July 1, 2000.

 

On December 28, 2001, the County Manager’s Office approved an Agreement, which included evaluation services under the California Department of Health Services, Tobacco Control Section (CDHS/TCS), Proposition 99, and Tobacco Master Settlement Agreement Funds (MSA). This Agreement has been amended on two previous occasions to provide services under CDHS/TCS funding, which includes evaluation services for Young Adult Grant Services and Youth Coalition Services, to increase funding by $8,000 and to extend the term of Young Adult Grant Services through FY 2004-05.

 

Discussion

This Third Amendment will increase the Agreement by $46,500 and extend the term from June 30, 2005 to June 30, 2007. The increase in funds and term extension will allow Proposition 99 and MSA evaluation services to continue through June 30, 2007. However, the Youth Coalition evaluation services will only be extended to February 28, 2005 and the Young Adult Grant Services will end June 30, 2005.

 

This contract is designed to implement evaluation activities to allowed the program to achieve the following four goals: (1) reduce the community’s exposure to second-hand smoke; (2) reduce the availability of tobacco products; (3) counter pro-tobacco influences; and (4) promote available cessation services.

 

The Human Services Agency is requesting that the Board of Supervisors waive the RFP Process for the purpose of extending the Agreement with Martin L. Forst to June 30, 2007. Martin L. Forst is specified in the CDHS/TCS grant and the Proposition 99 Allocation Agreement as the evaluator for tobacco prevention services.

 

County Counsel has reviewed and approved this Third Amendment as to form. Risk Management has approved the Contractor’s insurance Coverage.

 

Performance Measures

Evaluation services are provided under Proposition 99, MSA and Youth Coalition funding to evaluate program interventions. Performance measures include: evaluation design, creation of qualitative and quantitative evaluation tools, data collection and data analysis. All necessary evaluation reports will be completed by June 30, 2007.

Evaluation final reports will determine whether the following program objectives were attained through a comprehensive qualitative and quantitative analysis.

    1. At least two public school districts within San Mateo County will adopt a selective purchase policy indicating that tobacco company subsidiary food products will not be bought.

    2. In three communities within San Mateo County, illegal sales of tobacco to minors will be reduced to 10 % as determined by youth tobacco purchase surveys.

    3. At least three cities in San Mateo county will adopt a tobacco licensing policy and/or strengthen an existing policy that mandates compliance checks of retailers at least two times a year and includes sufficient fees to conduct checks.

    4. At least three outdoor and/or community venues (e.g. beaches, county fairs, community parades, farmers markets) in San Mateo County will adopt tobacco control policies designating a portion or all of the outdoor area or event as smoke free.

    5. The proportion of teachers and staff from at least 10 middle, high and/or schools in San Mateo county who report receiving tobacco use prevention specific training (i.e. CDE approved evidence-based curriculum)in the previous year will increase 20% from the baseline

 

The Goals for Young Adult Grant Services remain the same and goals are on target.

 

Vision Alignment

The Agreement with Martin L. Forst keeps the commitment of: Ensure basic health and safety for all and goal number 8: Help vulnerable people – the aged, disabled, mentally ill, at-risk youth and others – achieve a better quality of life. This Agreement contributes to this commitment and goal by providing opportunities for young people to influence community norms about secondhand smoke exposure to reduce greater access to tobacco and to counter pro tobacco influence within San Mateo County.

 

Fiscal Impact

This Third Amendment increases the Agreement from $109,000 to $155,500 and extends the term from June 30, 2005 through June 30, 2007. Funding for this Third Amendment is provided through the CDHS/TCS, and MSA funds and has been included in the FY 2004-05 Recommended Budget. There is no Net County Cost.
