Resolution Authorizing an Increase in the Not-To-Exceed Contract Payments for the Phase I - Renovation of Windows and Glazing Building "A" & "B" at Maguire Correctional Facility Project (Projects No. P7D02, P7D03 & P7G01)

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on June 24, 2003, adopt Resolution No. 66112, which awarded and authorized execution of a contract with Best Roofing and Waterproofing Inc., for the Renovation of Windows and Glazing at Maguire Correctional Facility, 300 Bradford, Redwood City, and

WHEREAS, the County did enter into an agreement with Best Roofing and Waterproofing Inc., as authorized by said resolution; and

WHEREAS, the Agreement provides that aggregate payments to Best Roofing and Waterproofing Inc., shall not exceed $429,000 without this Board's approval; and

WHEREAS, The Director of Public Works has recommended that the not to exceed figure as originally approved by this Board be increased to include all remaining Additive Alternates; and

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

The Agreement is hereby amended to provide that aggregate payments to Best Roofing and Waterproofing Inc., for said work shall not exceed the sum of Six Hundred Fifty-Nine Thousand and No/100 Dollars ($659,000.00) without this Board's approval.

2.

That, with the exception of modification as herein provided, the Agreement with Best Roofing and Waterproofing, Inc., entered on June 24, 2003, shall remain unchanged.
