Extension of Interim Zoning Regulations for Bed and Breakfast Inns Outside the Coastal Zone (4/5 Vote Required)

 

RECOMMENDATION

Adopt an ordinance extending interim regulations for the short-term rental of rooms (commonly known as a bed and breakfast inn) in residential districts outside the coastal zone for an additional period of ten months and fifteen days (4/5 vote required).

 

BACKGROUND

On December 16, 2003 your Board adopted urgency interim zoning regulations for the short-term rental of rooms (commonly known as a bed and breakfast inn) in residential areas outside the coastal zone. Such regulations remain in effect for 45 days, during which period they may be extended for up to an additional 10 ½ months. Extension requires a public hearing noticed in accordance with the standard requirements for adoption of amendments to zoning regulations and the agency must report on progress toward adoption of permanent regulations or other actions designed to address the problem that led to adoption of the urgency ordinance.

 

Since your December 16, 2003 meeting staff has established a schedule for this project that would have permanent regulations before the Planning Commission for public hearing in March 2004. Work that will be completed prior to those hearings includes research on bed and breakfast regulations in place in other jurisdictions and possible refinement of the regulations adopted in December to address concerns raised by the public at and subsequent to your December hearing.

 

Notice of your January 27 hearing to extend the regulations was accomplished through publication of a one-eighth-page ad in a local newspaper of general circulation and by mailed notice to those persons who corresponded with the County on this matter or who spoke at the December 16 hearing.

 

Two clarifying changes are recommended to the ordinance adopted on December 16: (1) a specific statement that the limitations on hosting do not apply to personal social events or meetings engaged in by persons occupying the dwelling as a single family residence, and (2) the addition of a severability clause. Otherwise the ordinance remains as adopted.

 

Environmental Review. Adoption of the interim regulations is exempt from review under the California Environmental Quality Act under 14 California Code of Regulations Section 15061(b)(3) because there is no possibility that the interim regulations, which impose further restrictions on development, will have the potential for causing a significant effect on the environment.

 

VISION ALIGNMENT

Adoption of these regulations would serve the commitment to redesign our urban environment to increase vitality, expand variety and reduce congestion and the related goal that land use decisions consider transportation and other infrastructure needs as well as impacts on the environment and on surrounding communities. They would also serve the commitment to responsive, effective and collaborative government and the related goal that government decisions be based on careful consideration of future impact, rather than temporary relief or immediate gain.

 

FISCAL IMPACT

 

No direct fiscal impact expected from the adoption of this Ordinance.
