Resolution Authorizing Execution of the Third Amendment to the Franchise Agreement Between the County of San Mateo and BFI Waste Systems of North America, Inc. for Solid Waste, Recyclable Materials and Plant Materials Collection Services in County Service Area No. 8 - North Fair Oaks Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County of San Mateo ("County") and BFI Waste Systems of North America, Inc. ("BFI") have entered into a Franchise Agreement dated February 8, 2000, and effective January 1, 2000 ("Franchise Agreement"), which sets forth the terms and conditions of solid waste, recyclable materials and plant materials collection services in County Service Area No. 8 ("CSA8"), the North Fair Oaks area; and

 

WHEREAS, the County is a member agency of the South Bayside Waste Management Authority ("Authority"), and the Authority, on behalf of the County and the other member agencies of the Authority, has developed a proposal with BFI for a Commercial Organics Collection Program; and

 

WHEREAS, said Commercial Organics Collection Program would benefit the County and CSA8 by diverting the organic solid waste of qualifying commercial customers from landfill disposal; and

 

WHEREAS, this Board desires reduce the solid waste collection rates by twenty-five percent (25%) for qualifying commercial customers in CSA8 who participate in the Commercial Organics Collection Program so as to encourage participation and maximize the benefit to the County and CSA8; and

 

WHEREAS, an amendment to the Franchise Agreement incorporating said Commercial Organics Collection Program in its terms and conditions has been prepared and presented to this Board for its consideration, and this Board finds it necessary and desirable that said amendment be executed on behalf of the County of San Mateo.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

The President of this Board of Supervisors be, and is hereby, authorized and directed to execute the Third Amendment to the Franchise Agreement Between the County of San Mateo and BFI Waste Systems of North America, Inc. for Solid Waste, Recyclable Materials and Plant Materials Collection Services for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest to the President's signature thereto.

 

2.

The rate paid for solid waste collection service by customers in County Service Area No. 8 who participate in the Commercial Organics Collection Program shall be reduced by twenty-five percent (25%) from the rates in effect as adopted by this Board.
