RESOLUTION IN SUPPORT OF ASSEMBLY BILL 1195 (COHN) REGARDING EMINENT DOMAIN POWERS FOR THE MIDPENINSULA REGIONAL OPEN-SPACE DISTRICT ANNEXATION PROJECT |

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that |
|
WHEREAS, the Midpeninsula Regional Open Space District is in the process of annexing approximately 140,000 acres of the southern and mid-coast of the County of San Mateo; and |
|
WHEREAS, some residents and property owners in the proposed annexation area have expressed concerns about the Midpeninsula Regional Open Space District's eminent domain powers; and |
|
WHEREAS, the San Mateo County Farm Bureau and the Midpeninsula Regional Open Space District have reached a compromise, as memorialized in a memorandum of understanding, regarding the power of eminent domain in the proposed area for annexation; and |
|
WHEREAS, Assembly Bill 1195 would prohibit the Midpeninsula Regional Open Space District (MROSD) from using eminent domain to acquire real property or interest in real property in the San Mateo County Coastal Annexation Area; and |
|
WHEREAS, support of Senate Bill 131 (Sher) would help the County provide responsive, effective and collaborative government and work toward Goal #20-to ensure that government decisions are based on careful consideration of future impact, rather than temporary relief or immediate gain; |
|
NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the San Mateo County Board of Supervisors by the adoption of this resolution hereby supports Assembly Bill 1195 (Cohn). |
