RESOLUTION TO AUTHORIZE THE EXECUTION OF THIRD AMENDMENTS TO TWO AGREEMENTS WITH ELECTION SYSTEMS & SOFTWARE, INC. FOR LICENSING AND MAINTENANCE-SUPPORT SERVICES RELATING TO A VOTER REGISTRATION-ELECTION MANAGEMENT SYSTEM AND A VOTE TABULATION SYSTEM

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the utmost accuracy, security, and integrity are essential to all our voter registration, election management, and vote tabulation processes; and

WHEREAS, County's Chief Elections Officer recommends the third amendment of two agreements with Election Systems & Software, Inc. for continued licensing, improvement, and support of County's existing automated systems for voter registration, election management, and vote tabulation; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, a third amendment to a 1992 agreement (reference to which is hereby made for further particulars) to license, implement, maintain, and support County's vote tabulation system for a six-year period ending December 31, 2009 for an amount not to exceed $255,528 annually (NTE $1,533,168 in total); and;

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, a third amendment to a 1994 agreement (reference to which is hereby made for further particulars) to license, implement, maintain, and support a software upgrade of the County's voter registration-election management system, for a six-year period ending December 31, 2009 for an amount not to exceed $131,800 annually (NTE $790,800 in total); and;

WHEREAS, the County Manager has approved six-year terms for said agreements; and

WHEREAS, this Board of Supervisors has examined and approved said amendments as to both form and content and desires to approve them;

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors is hereby authorized and directed to execute said two amendments for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.
