Resolution Authorizing the Levying of Assessments and the Collection Thereof for the El Granada Roadway and Drainage Improvement Project - MidCoast Area (Projects No. R6F00, R6G00 and R6H00 - F-36 [231])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors did, on July 11, 2000, and September 12, 2000, adopt Resolutions No. 63758 and 63913, respectively, which Resolutions authorized the Director of Public Works to complete plans and specifications and to notify property owners of this Board's intent to complete plans and levy assessments against property owners for the El Granada Roadway and Drainage Improvement Project - Paloma, San Carlos, Escalona, Navarra, Ferdinand and San Juan Avenues - El Granada Area of the MidCoast; and

 

WHEREAS, this Board has fully complied with the notice and hearing requirements imposed by Government Code Section 53753 (Proposition 218 Implementation Act) and Article XIIID of the State Constitution, and

 

WHEREAS, the subject improvements have been completed and the Director of Public Works has determined the assessments related to the cost of said improvements; and

 

WHEREAS, this Board held a public hearing pursuant to Section 5870 et. seq. of the Streets and Highways Code and heard and considered any and all objections to said assessments as previously described.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

 

1.

The assessments identified in the Director of Public Works' Final Report (Resolution No. 66461, Exhibit A, January 27, 2004) attached hereto and identified as Exhibit A, and hereby levied on the parcels and in the amount indicated in the Director's report.

The Director of Public Works is hereby ordered to cause the collection of unpaid assessments within forty-five (45) days of approval of this resolution. If an assessment has not been paid within said forty-five (45) day time period, the assessment shall become a lien against the parcel of property and the Director of Public Works shall cause a notice of lien to be recorded as provided by Section 5890 et seq. of the State of California Streets and Highways Code.

Payments of assessments that become liens shall be made together with the property taxes for those properties for which the assessments have not been paid within the 45-day period as described above, and shall be paid over a ten year period and shall include interest at a rate of seven percent (7%) per year.
