RESOLUTION AUTHORIZING TOWING OF VEHICLES UNLAWFULLY PARKED ON CERTAIN COUNTY PREMISES FOR THE DURATION OF THE

PEOPLE v. SCOTT PETERSON TRIAL

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the county owns and maintains parking facilities and lots in the vicinity of the County Government Center in which parking is restricted and general public parking is prohibited, including the Juror Parking Lot located off Middlefield Road; the Employee, and Boards and Commissions Lot off Winslow Street; the Car Pool lot located off Winslow Street alongside the County Law Library and to the rear of that building; the Car Pool lot located on Marshall Street between Hamilton and Middlefield; the Motor Pool lot off Winslow Street; the Ground Floor of the County Parking Structure, located at 400 Middlefield Road; and County Center Street parking areas; (formerly Hamilton Street), which areas are clearly marked on the attached map; and

 

WHEREAS, for the duration of the People v. Scott Peterson trial in the San Mateo Superior Court, it is expected that there will be an extraordinary demand on parking resources in the vicinity of the County Government Center; and

 

WHEREAS, this Board of Supervisors wishes to ensure that parking spaces that have been designated and posted as restricted parking be maintained available for those for whose they have been designated; and

 

WHEREAS, Vehicle Code §22651 provides that any peace officer who is engaged in enforcing parking laws and regulations may remove a vehicle whenever any vehicle is parked or left standing where local authorities, by resolution or ordinance, have prohibited parking and have authorized the removal of vehicles, provided that no vehicle may be removed unless signs are posted giving notice of the removal; and

 

WHEREAS, the Sheriff has already posted the necessary signs so that drivers have plenty of advance notice of the County's intention to tow; and

 

WHEREAS, for the duration of the People v. Scott Peterson proceedings in the San Mateo Superior Court, this Board of Supervisors wishes to authorize the Sheriff to remove or to have removed any and all vehicles that are unlawfully parked in the Juror Parking Lot located off Middlefield Road; the Employee, and Boards and Commissions Lot off Winslow Street; the Car Pool lot located off Winslow Street alongside the County Law Library and to the rear of that building; the Car Pool lot located on Marshall Street between Hamilton and Middlefield; the Motor Pool lot off Winslow Street; the Motor Pool lot off Winslow Street; the Ground Floor of the County Parking Structure, located at 400 Middlefield Road; and County Center Street parking areas (formerly Hamilton Street), which areas are clearly marked on the attached map;

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the during the duration of the People v. Scott Peterson proceedings in the San Mateo Superior Court, the Sheriff is hereby authorized to remove or to have removed any and all vehicles that are unlawfully parked in the Juror Parking Lot located off Middlefield Road; the Employee, and Boards and Commissions Lot off Winslow Street; the Car Pool lot located off Winslow Street alongside the County Law Library and to the rear of that building; the Car Pool lot located on Marshall Street between Hamilton and Middlefield; the Motor Pool lot off Winslow Street; the Ground Floor of the County Parking Structure, located at 400 Middlefield Road; and County Center Street parking areas (formerly Hamilton Street), which areas are clearly marked on the attached map.
