APPLICATION FOR LEAVE TO PRESENT A LATE CLAIM |
G01-173 |
Reyes, Jeff |
2/7/02 No statutory basis for excuse |
11/24/03 |
Claimants request leave to present a late claim wherein he, a minor, alleges he was struck by a truck while crossing Selby Lane in Atherton to go to school due to the dangerous condition of the roadway. |
When a claim is late, state law permits applications to file late claims but only if the application is filed within one year of the accrual of the cause of action. This application to file a late claim is filed more than one year after the accrual of the cause of action and denial is therefore recommended. |
