Amendment One to the Agreement with AchieveKids (formerly known as Achieve)

 

Recommendation

Adopt a resolution authorizing the President of the Board to execute an Amendment to the Agreement with AchieveKids.

 

Background

For over 11 years AchieveKids has provided non-public school intensive mental health services for children and adolescents (ages 6 to 18) with complex emotional, behavioral, and developmental problems. On September 25, 2001, your Board approved an Agreement with AchieveKids to provide non-public school intensive services for emotionally and behaviorally disturbed children and adolescents, early interventions outpatient services for children ages three to six, and administrative services of the Mental Health Division's Wrap-Around Funds and Shadow Program. The Shadow Program is a mentoring program that employs adults to provide one-on-one interaction with youth referred by San Mateo County Mental Health Services. The term of the Agreement was July 1, 2001 through June 30, 2004. AchieveKids changed its name from Achieve in 2002.

 

Discussion

This amendment more precisely defines the services provided by AchieveKids and cancels other services that it no longer provides. The new definitions are the result of changes in state Mental Health regulations.

 

As of July 1, 2003 the California State Department of Mental Health has imposed new regulations and staffing requirements for Medi-Cal reimbursement of Day Treatment Intensive Services and Day Treatment Rehabilitative Services. As a result, AchieveKids has transitioned from providing Day Treatment Intensive Services to providing Day Treatment Rehabilitative Services and Outpatient Mental Health Services. This Agreement is being amended to clarify service and documentation procedures for Day Treatment Rehabilitative Services and Outpatient Mental Health Services according to these new regulations.

 

Effective November 1, 2003, AchieveKids discontinued providing administrative services of the Wrap-Around Funds and Shadow Program. New end-dates for these services are included in this amended Agreement. New Health Insurance Portability and Accountability Act of 1996 (HIPAA) requirements have also been added to this amended Agreement.

 

Vision Alignment

This amended Agreement with AchieveKids keeps the commitment to Ensure Basic Health and Safety for All and goal number 8: Help vulnerable people-the aged, disabled, mentally ill, at risk youth, and others- achieve a better quality of life. The amended Agreement contributes to this commitment and goal by providing non-public school Day Treatment Rehabilitative Services and Outpatient Mental Health Services for emotionally and behaviorally disturbed children and adolescents.

 

Fiscal Impact

The term of this amended Agreement remains July 1, 2001 through June 30, 2004. The Amendment has been reviewed and approved by Risk Management and County Counsel.

 

The amended Agreement maximum of $950,712 covers the three-year Agreement term. This is a $921,383 reduction from the original Agreement maximum of $1,872,095, which reflects a lower level of use of the contract services and the discontinuation of administrative services of the Wrap-Around Fund and Shadow Program.

 

The Agreement maximum for FY 2003-04 is $150,232. It is expected that state and federal Medi-Cal funds will cover $37,477 of the costs. The State Department of Social Services (DSS SB 163) Wrap-Around pilot project funds and State DSS STOP funds will cover the entire $40,000 cost of the Wrap-Around Fund and Shadow Program administrative services, which were provided through October 31, 2003. $34,553 will be funded by State allocations for AB3632 services, and sales tax through realignment will cover $12,135. The net County cost is $26,067, which is included in the FY 2003-04 approved budget.
