SUBJECT:

A Resolution accepting the Certificate of the Chief Elections Officer as the Statement of the Vote as determined by the official canvass of the March 2, 2004 Presidential Primary Election, declaring the person or persons elected to certain offices, declaring the person or persons who have filed declarations of candidacy be appointed to certain partisan central committee offices in lieu of holding an Election, and declaring the results of certain measures voted on.

 

RECOMMENDATION:

Adopt a Resolution accepting the Certificate of the Chief Elections Officer as the Statement of the Vote as determined by the official canvass of the March 2, 2004 Presidential Primary Election, declaring the person or persons elected to certain offices, declaring the person or persons who have filed declarations of candidacy be appointed to certain partisan central committee offices in lieu of holding an Election, and declaring the results of certain measures voted on.

 

BACKGROUND:

Elections Code §§10411 and 15300 et seq. authorize and direct the Board of Supervisors and the Chief Elections Officer, within 28 days of an election, to inspect, process, and count all ballots and prepare a certified statement of the result, and to deliver a duplicate of that statement to the Secretary of State and to the chairperson of the county central committee of each political party. Upon acceptance of this statement, Elections Code §15400 authorizes and directs the governing body of the jurisdiction to declare elected or nominated the persons having the highest number of votes for the offices voted on and to declare the results of the election as to each measure (proposition) voted on.

 

DISCUSSION:

On March 2, 2004, the Chief Elections Officer conducted a Presidential Primary Election. The official canvass and an abstract or Statement of the Vote was completed and certified by the Chief Elections Officer, and is available at the Registration-Elections Division. In the resolution for your adoption, you will be declaring elected, three Members to this Board and also several seats for the Democratic, Republican, and Green Party partisan county central committees and councils. In addition, there are also several appointments in lieu of holding elections for the Democratic, Republican, and Libertarian Party county central committees.

 

This resolution has been reviewed and approved by County Counsel.

The proposed resolution keeps the County's commitments and furthers progress towards its goals: (1) realizing the potential of our diverse population - civic engagement including voting and participation in public discussions of important issues; (2) supporting responsive, effective and collaborative government - County and local governments effectively communicate and develop strategic approaches to issues affecting the County; and (3) supporting leaders working together across boundaries to preserve and enhance our quality of life - as residents express their support for regional, collaborative approaches to issues and accepting individual responsibility for contributing to the quality of life of the County as a whole.

 

FISCAL IMPACT:

There is no fiscal impact.
