AN ORDINANCE AMENDING CHAPTER 1.30 (MOBILEHOME RENT CONTROL) OF TITLE 1 OF THE SAN MATEO COUNTY ORDINANCE CODE

 

The Board of Supervisors of the County of San Mateo, State of California, ORDAINS as follows:

 

Section 1. Section 1.30.110 (Severability) of Chapter 1.30, Title 1 of the San Mateo County Ordinance Code, is hereby renumbered as Section 1.30.120.

 

Section 2. A new Section 1.30.110 (Exemption) is hereby added to Chapter 1.30, Title 1 of the San Mateo County Ordinance Code to read as follows:

 

    Section 1.30.110. Exemption.

 

    A one time increase in rent exceeding the maximum rent increase specified in Section 1.30.030 shall be allowed without complying with the requirements of this Chapter under the following circumstances:

 

    1. The proposed increase in rents are proposed in connection with the sale of the mobilehome park to a non-profit corporation.

 

    2. The proposed increase in rents are necessary to secure financing for purchase of the park through the issuance of revenue bonds in accordance with Chapter 5 of Division 31 of the California Health and Safety Code, relating to the financing of multifamily rental housing, including mobilehome parks.

 

    3. A written petition or petitions are submitted by a minimum of two-thirds (2/3) of the mobilehome tenants indicating support for the increase in rents.

 

    An exemption under this Section shall only be effective upon written acknowledgement of the San Mateo County Environmental Services Agency Director, issued after submission of documentation establishing the conditions for an exemption as specified above. Any rent increase under this Section may only be imposed if the proposed sale is concluded.

 

Section 3. This ordinance shall be effective thirty (30) days after the passage thereof.
