Increase in Independent Contractor Agreement Related to Work Performed for the Cupid's Row Canal Dredging Project - San Bruno Creek Flood Control Zone

 

Recommendation

Adopt a resolution authorizing an increase in the not-to-exceed amount of County Independent Contractor Agreement No. 48400-04-C066 with LSA Associates, Inc. (LSA) by $10,651.25 to $110,651.25.

 

Key Facts

1.

Dredging of the Cupid's Row Canal of the San Bruno Creek Flood Control District (Project) was necessary in order to minimize the potential for flooding of the nearby neighborhoods.

The permits that we received from the State of California Department of Fish and Game and the United States Fish and Wildlife Service for the Project required extensive biological monitoring as the area is habitat for the San Francisco Garter Snake (snake) and the California Red-Legged Frog (frog).

LSA performed a portion of the required biological monitoring for the Project, which exceeded their current contract not-to-exceed amount by $10,651.25.

 

Discussion

The Cupid's Row Canal of the San Bruno Creek Flood Control Zone is located on San Francisco Airport property and transports stormwater from areas within the City of San Bruno to the San Francisco Bay.

 

The Project was necessary in order to provide flood protection for the surrounding residential and business areas, and the completion of the Project was critical, as residents in the area adjacent to the Canal were flooded during a storm event in 2002. We retained LSA to do a portion of the required biological monitoring in order to comply with the necessary State and Federal permits. However, the cost of monitoring exceeded the contract amount as the State and Federal permits associated with the work required monitors to:

Walk all trucks and equipment in and out of the work area to insure that garter snakes or frogs would not be run over as the trucks and equipment entered and exited that dredging area.

Inspect the channel prior to vegetation removal to insure the work area was clear of garter snakes and frogs.

   

¬

Hand excavate burrows on the sidebanks of the channel prior to dredging to insure that no snakes or frogs were in the burrows at the time of excavation.

Hand probe the area in the channel and its sidebanks to look for snakes and frogs prior to removal of any material by the excavator bucket.

   

¬

Hand inspect dredged material in the excavator bucket for snakes and frogs prior to dumping the material into the trucks.

   

¬

Hand inspect each bucket-load of dredged material in the truck to determine whether there were any snakes or frogs present.

Vision Alignment

We believe our recommendation is consistent with the Shared Vision Commitment to "ensure basic health and safety for all" and Goal Number 7 "maintain and enhance the public safety of all residents and visitors," as amending the Agreement will allow us to pay LSA for the additional biological monitoring that was required to complete the Project for the benefit of property owners and residents adjacent to the Canal.

 

Fiscal Impact

The increase in the contract amount, $10,651.25, is proposed to be financed with funds from the San Bruno Creek Flood Control Zone, as was the original contract amount of $100,000. There is no additional impact to the General Fund.

 

A form of resolution has been approved by County Counsel.
