Resolution Rescinding the Agreement for a Loan to Help Fund the Construction of a New Well in County Service Area No. 11 - Pescadero Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Board of Supervisors is the Governing Board of County Service Area No. 11 (CSA11); and

WHEREAS, CSA11 was offered a grant from the United States Department of Agriculture (USDA) in the amount of $135,000 to partially fund the construction of a new well to serve CSA11; and

WHEREAS, it was estimated that an additional $165,000 would be needed to fund the new well and the USDA required that said funding be identified and available as a condition of receiving the grant; and

WHEREAS, it was necessary and desirable that funds be advanced to CSA11 from the General Fund to finance the construction of the well; and

WHEREAS, a form of Agreement to loan funds from the General Fund to CSA11 that met the terms of the USDA grant requirements was presented to this Board and this Board authorized execution of said agreement for and on behalf of both CSA11 and the County; and

WHEREAS, subsequent to execution of the Agreement the Department of Public Works conducted a survey of the CSA11 customers and property owners who have purchased a connection to the water system regarding moving forward at this time with the well project; and

WHEREAS, the survey results indicate that there is no desire to move forward at this time with the construction of a new well; and

WHEREAS, this Board has determined that based on the results of said survey that the Director of Public Works should not proceed with the design of said new well; and

WHEREAS, this Board has also determined that the loan to CSA11 is no longer necessary; and

WHEREAS, no advance or loan of funds pursuant to said agreement have been made to CSA11.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that this Board hereby rescinds the agreement authorized by Resolution No. 66230 and entitled, "Agreement for the Loan of Funds to County Service Area No. 11 from the County General Fund," for and on behalf of both County Service Area 11 and the County of San Mateo.
