RESOLUTION AUTHORIZING THE COUNTY TO EXECUTE AN AGREEMENT BETWEEN TRUST FOR PUBLIC LAND AND COUNTY OF SAN MATEO FOR CONVEYANCE OF REAL PROPERTY IN SOUTH SAN FRANCISCO FROM TRUST FOR PUBLIC LAND, AUTHORIZE TRANSFER OF $325,000 OF ENVIRONMENTAL ENHANCEMENT AND MITIGATION PROGRAM GRANT FUNDS INTO ESCROW FOR ACQUISITION OF THE PRESERVATION PARCEL, DIRECT STAFF TO INCLUDE LANGUAGE IN THE UPDATE OF THE HABITAT CONSERVATION PLAN FOR SAN BRUNO MOUNTAIN TO INCLUDE THE PRESERVATION PARCEL IN THE HABITAT CONSERVATION PLAN AND AUTHORIZE THE DIRECTOR OF ENVIRONMENTAL SERVICES AGENCY TO SIGN AND EXECUTE AN ASSIGNMENT AND ASSUMPTION AGREEMENT AND CERTIFICATE OF ACCEPTANCE AS PART OF THE CLOSE OF ESCROW AND OTHER RELATED CLOSE OF ESCROW DOCUMENTS, ACCEPTANCE OF FUNDS AND ANY OTHER NECESSARY DOCUMENTS TO AFFECT THE LAND TRANSFER

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County's General Plan calls for the preservation of significant cultural resources;

WHEREAS, the City of South San Francisco, in conjunction with Myers Development Corporation has offered for sale property known as the Preservation Parcel (also known as the Shell Mounds) that contains significant Native American artifacts;

 

WHEREAS, Myers Development has reached agreement to sell the property to the Trust for Public Land, which entity then secured grants from the U.S. Fish and Wildlife Service, the San Francisco Foundation and the Ohlone People to acquire the property;

 

WHEREAS, the San Mateo County Board of Supervisors authorized the Director of the Environmental Services Agency to apply for funds from the Environmental Enhancement and Mitigation Program;

 

WHEREAS, an Agreement between Trust for Public Land and County of San Mateo for conveyance of a 26.1 acre parcel, pursuant to the terms and conditions therein stated, has been presented to this Board of Supervisors;

WHEREAS, this Board has read and considered the same and has determined that it is necessary and desirable that the same be executed for and on behalf of the County of San Mateo.

 

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

    1. That the President of the Board of Supervisors be, and is hereby, authorized and directed to execute the aforementioned Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto;

    2. That authorization is given for the transfer of $325,000 of Environmental Enhancement and Mitigation Program grant funds into escrow for acquisition of the Preservation Parcel;

    3. That staff is directed to include language in the update of the Habitat Conservation Plan for San Bruno Mountain to request that the Preservation Parcel be included in the Habitat Conservation Plan; and

    4. That the Director of the Environmental Service Agency is hereby authorized to execute on behalf of the County the Assignment and Assumption Agreement and Certificate of Acceptance as part of the escrow closing process and any other documents related to the close of escrow, acceptance of funds and any other documents necessary to complete the conveyance of the property, any required written notices and documents in connection with the Agreement.
