RESOLUTION AUTHORIZING EXECUTION OF A LEASE AGREEMENT BETWEEN THE COUNTY OF SAN MATEO AND SUNBOW INC., DBA AIR WEST AIRCRAFT ENGINES FOR THE LEASE OF AN AIRCRAFT MAINTENANCE FACILITY OF APPROXIMATELY 8,893 SQUARE FEET AT
SAN CARLOS AIRPORT, SAN CARLOS, CALIFORNIA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on December 7, 1999 the County of San Mateo and Sunbow Inc., dba Air West Aircraft Engines ("Air West"), as authorized by Resolution No. 63240, entered into a Lease and Concession Agreement ("Lease") for an aircraft maintenance facility at San Carlos Airport, San Carlos, California; and

WHEREAS, the Air West currently operates its business at San Carlos Airport under the holdover provision of the Lease, which expired on May 30, 2004; and

WHEREAS, the parties wish to enter a Lease/Concession Agreement commencing July 1, 2004 for a five-year term ending June 30, 2009 at the monthly rent of $6,000.00, which rent shall be adjusted annually based on the change in the Consumer Price Index; and

WHEREAS, the Lease/Concession Agreement provides a monthly concession fee in an amount equal to one percent (1%) of gross revenues, but not less than $500.00 per month; and

WHEREAS, this Board has been presented with a form of such Lease/Concession Agreement and said Board, having examined and approved the said Agreement as to both form and content, desire to enter into said Lease/Concession Agreement.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

1. That the President of this Board of Supervisors be, and is hereby, authorized and directed to execute the Lease/Concession Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

2. That the County Manager, or his designee, is hereby authorized to accept, execute and/or agree to on behalf of the County, any and all amendments, options, notices, consents, approvals, and documents in connection with the Lease/Concession Agreement, except as otherwise provided by applicable law, including the County's Ordinance Code and Charter.
