Consideration of a General Plan Amendment to Add Supporting Information to the Adopted Housing Element

 
 

RECOMMENDATION

 

Adopt a resolution approving a General Plan Amendment to add supporting information to the adopted Housing Element.

 

PROPOSAL

 

Staff is proposing a General Plan Amendment to formally incorporate supporting information into the Housing Element as recommended by the State Housing and Community Development Department (HCD) to achieve compliance with State Housing Element Law. The information to be added does not substantially change the Housing Element, but rather clarifies redevelopment potential for unincorporated lands included in the Land Inventory, and clarifies where Homeless Shelters and Transitional Housing are allowed.

 

BACKGROUND

 

On December 16, 2003, your Board adopted a revised, updated Housing Element (General Plan Chapter 14). Staff then submitted the Housing Element to State HCD for determination of conformance with State Housing Element Law (Government Code Article 10.6). As stated in their letter to the County dated May 6, 2004 (Attachment A), State HCD is recommending that some clarifying information submitted by staff in the course of the review should be added to the Element so that it will fully comply with the law. This General Plan Amendment is proposed to formally incorporate that information into the Element.

 

SUMMARY

 

The amendment will add supporting information to the adopted Housing Element as summarized below and shown on Attachments B, C and D. On each attachment, the added text is shaded. The proposed additions do not constitute substantial changes, but merely clarify:

 

1.

Short-term redevelopment potential in the Colma BART Station Area, confirming the County’s ability to meet its Regional Housing Need Allocation (Attachment B).

   

2.

Development and redevelopment potential, whether land is vacant or underutilized, and parcel numbers and sizes for lands included in the Land Inventory (Attachment C).

   

3.

The zoning districts where homeless shelters and transitional housing facilities are allowed in unincorporated areas (Attachment D).

   

If the Board approves the proposed amendment, staff will then transmit the amended Housing Element to State HCD for review and confirmation that the Element complies with State Housing Element Law. Normally, HCD has up to 90 days to submit comments on an adopted Housing Element. However, HCD has indicated they will expedite the review, given the minor nature of the amendment.

 

ENVIRONMENTAL REVIEW

 

The Board certified a Negative Declaration for the revision of the General Plan Housing Element on December 16, 2003. This amendment falls within the scope of that project as the information to be added clarifies data previously reported in the Element; no significant changes are proposed.

VISION ALIGNMENT

 

The Housing Element keeps the Commitment of offering a full range of housing choices, and supports Goal Number 9, ensuring that housing exists for people at all income levels and for all generations of families. The Housing Element contributes to this commitment and goal by providing a comprehensive set of policies and implementation programs to promote housing for all income groups in the unincorporated areas of the County.
