Authorization to Construct the Colma Creek Habitat Mitigation Project Using County Forces and Independent Contractors

 

Recommendation

Acting as the governing board of the San Mateo County Flood Control District, adopt a resolution authorizing the Director of Public Works to have the referenced work done by force account with County staff or with independent contractors.

 

Previous Board Action

1.

Adopted Resolution No. 66727 on June 8, 2004, adopting plans and specifications, determining prevailing wage scales, and calling for sealed proposals for the above referenced project.

 

2.

Authorized the Director of Public Works to execute agreements with independent contractors for work less than $100,000 on County projects.

 

Key Facts

1.

Section 22038 of the Public Contract Code provides that a public agency may decide to have a project performed by the employees of the public agency by force account or negotiated contract if no bids are received through the bidding procedures.

No bids were received for the work.

 

Discussion

We are required to mitigate the impacts to 0.50 acres of Clean Water Act (CWA) Section 404 jurisdictional wetlands (Jurisdictional Wetlands) as a result of implementing flood control improvement in Colma Creek between Spruce and San Mateo Avenues in the City of South San Francisco. The Mitigation Project was advertised for bids and five general contractors purchased and obtained bid documents. However, no bids were received by the bid opening date of July 19, 2004.

 

We are recommending that your Board approve our using County forces and independent contractors to do the work as provided by the Public Contract Code since no bids were received, as the permits for the work that were obtained from the various regulatory agencies require us to begin the work this construction season. We also do not believe that re-advertising the work will result in our receiving competitive bids, as the work is a combination of specialty work as it consists of removing invasive smooth cord grass (Spartina alternaflora), saving native grass species, grading the reclamation areas and then replanting and maintaining the areas to increase the available wetland habitat for the California clapper rail (Rallus longirostris obsoletus) and other species.

 

Vision Alignment

We believe our recommendation is consistent with the Shared Commitment to “preserve and provide people access to our natural environment” and Goal Number 14, “important natural resources are preserved and enhanced through environmental stewardship,” as allowing the proposed mitigation project to go forward will improve the wetland habitat quality, and increase available wetland habitat for endangered species.

 

Fiscal Impact

The estimated cost for implementing the mitigation project is $350,000, and funds from the Colma Creek Flood Control Zone of the San Mateo County Flood Control District have been appropriated to finance this work.

 

There is no impact to the General Fund.

 

A form of resolution has been approved by County Counsel.
