RESOLUTION

RESOLUTION AUTHORIZING THE REQUEST FOR PROPOSAL PROCESS TO BE WAIVED AND THE EXECUTION OF FLAT RATE ALCOHOL AND DRUG TREATMENT AND PREVENTION AGREEMENTS WITH 1) ASIAN AMERICAN RECOVERY SERVICES, INC.; 2) DAYTOP VILLAGE, INC.; 3) EL CENTRO DE LIBERTAD; 4) FREE AT LAST; 5) HORIZON SERVICES, INC.; 6) THE LATINO COMMISSION; 7) PROJECT NINETY, INC.; 8) PYRAMID ALTERNATIVES; 9) SERVICE LEAGUE OF SAN MATEO COUNTY; 10) SITIKE COUNSELING CENTER; 11) YOUTH AND FAMILY ENRICHMENT SERVICES; AND 12) WOMEN’S RECOVERY ASSOCIATION; AND AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY TO EXECUTE AMENDMENTS; HOWEVER, AS TO EACH AGREEMENT, SUCH AUTHORITY IS LIMITED TO:

    A) REDUCING THE COUNTY’S MAXIMUM FISCAL OBLIGATION IN THE EVENT THERE IS A COMMENSURATE REDUCTION IN THE FUNDING RECEIVED BY THE COUNTY;

    B) INCREASING THE COUNTY’S MAXIMUM FISCAL OBLIGATION IN THE EVENT THERE IS A COMMENSURATE INCREASE IN THE FUNDING RECEIVED BY THE COUNTY; HOWEVER, SAID INCREASE SHALL BE LIMITED TO A TOTAL OF $25,000 PER AGREEMENT; AND/OR

    C) MAKING CHANGES IN THE TYPES OF TREATMENT SERVICES PROVIDED BY CONTRACTORS AS LONG AS THE CHANGES HAVE NO IMPACT ON THE COUNTY’S MAXIMUM FISCAL OBLIGATION.

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance Agreements with 1) Asian American Recovery Services, Inc.; 2) Daytop Village, Inc.; 3) El Centro De Libertad; 4) Free At Last; 5) Horizon Services, Inc.; 6) The Latino Commission; 7) Project Ninety, Inc.; 8) Pyramid Alternatives; 9) Service League of San Mateo County; 10) Sitike Counseling Center; 11) Youth and Family Enrichment Services; and 12) Women’s Recovery Association; to provide Flat-Rate based alcohol and drug prevention, and treatment services under contracts with the County of San Mateo; and

 

WHEREAS, the term of these Agreements are July 1, 2004 through June 30, 2004, and the amount of each Agreement is as follows: 1) Asian American Recovery Services, Inc. ($371,115); 2) Daytop Village, Inc. ($708,100); 3) El Centro De Libertad ($368,807); 4) Free At Last ($512,955); 5) Horizon Services, Inc. ($562,635); 6) The Latino Commission ($420,877); 7) Project Ninety, Inc. ($1,038,892); 8) Pyramid Alternatives ($241,300); 9) Service League of San Mateo County ($232,756); 10) Sitike Counseling Center ($249,078); 11) Youth and Family Enrichment Services ($771,389); and 12) Women’s Recovery Association ($763,528); and

 

WHEREAS, Human Services Agency is requesting that the Board of Supervisors waive the Request for Proposal Process as it is in the County’s best interest to continue to contract with these Contractors so that there are no break in services to the community and in order to provide stability to the network of service providers as the County works through the transition in Proposition 36 program design; and

 

WHEREAS, this Board has been presented with forms of these Agreements and has examined and approved them as to both form and content and desires to enter into these Agreements.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED, that the

President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreements for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

 

BE IT FURTHER RESOLVED, that the Request for Proposal Process is waived and the Director of the Human Services Agency shall be authorized to execute subsequent amendments and minor modifications thereto during the initial term of these Agreements; however, as to each Agreement, such authority is limited to:

    a) Reducing the County’s maximum fiscal obligation in the event there is a commensurate reduction in the funding received by the County;

    b) Increasing the County’s maximum fiscal obligation in the event there is a commensurate increase in the funding received by the County; however, said increase shall be limited to a total of $25,000 per Agreement; and/or

    c) Making changes in the types of treatment services provided by Contractors, as long as the changes have no impact on the County’s maximum fiscal obligation.
