Application for Federal Surface Transportation Program Funding for the Resurfacing of Various Streets in the West Menlo Park Area

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the Transportation Equity Act for the 21st Century (TEA 21) (Public Law 105-178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206, July 22, 1998), continue the Surface Transportation Program (23 U.S.C. § 133 and the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. § 149); and

 

WHEREAS, the TEA-21 legislation will guide the programming of various federal highway programs until a TEA-21 Reauthorization bill is authorized; and

 

WHEREAS, pursuant to TEA-21 and the regulations promulgated there under, eligible project sponsors wishing to receive Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program grants for a project must first submit an application to the appropriate metropolitan transportation planning organization (MPO), for review and inclusion in the MPO's Transportation Improvement Program (TIP); and

 

WHEREAS, the Metropolitan Transportation Commission is the MPO for the San Francisco Bay region; and

 

WHEREAS, the County of San Mateo is an eligible project sponsor for Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds; and

 

WHEREAS, the Director of Public Works has recommended that the County submit an application to MTC for funds from the Surface Transportation Program in fiscal years 2005-06 and 2006-07 for the resurfacing of portion of the Alameda de las Pulgas, Valparaiso Avenue and Harkins Avenue in the West Menlo Park area; and

 

WHEREAS, Attachment A attached hereto and incorporated herein as though set forth at length, includes the certification of assurances by the County of San Mateo for the Resurfacing of Various Streets in West Menlo Park Area required for the programming of funds by MTC; and

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED that:

 

A.

The Director of Public Works is authorized to execute and file an application, which includes the certification of assurances (Attachment A), for funding under the Surface Transportation Program of TEA-21 Reauthorization in the amount of $500,000 for 2005-2006 to help finance the cost of resurfacing of portions of the Alameda de las Pulgas, Valparaiso Avenue and Harkins Avenue in the West Menlo Park area.

 

B.

This Board will provide $106,000 in non-federal matching funds for the project.

 

C.

This Board is aware that the Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funding for the project is fixed at $500,000, and that any cost increases must be funded by the County from local matching funds, and that this Board does not expect any cost increases to be funded with Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds.

 

D.

The funds will be used to resurface the streets as described in this resolution and for the amount shown in the Metropolitan Transportation Commission (MTC) Transportation Improvement Program (TIP), if the project is approved, with obligation occurring within the timeframe established as described below.

 

E.

The program funds are expected to be obligated by June 30th of the year the project is programmed in MTC’s TIP.

 

F.

The County is an eligible sponsor of projects in the Surface Transportation Program.

 

G.

The County is authorized to submit an application for State Transportation Program funds for the Resurfacing of Various Streets in West Menlo Park Area.

 

H.

There is no legal impediment to the County making an application for Local Streets and Roads Shortfall Program funds.

 

I.

The is no pending or threatened litigation which might in any way adversely affect the proposed project, or the ability of the County to construct said project.

 

J.

The Director of Public Works is hereby directed to file a copy of this resolution with MTC together with the application for grant funds.

 

K.

MTC is requested to support the application for the project described in the resolution and to program the project, if approved, in MTC's TIP.
