Resolution Awarding and Authorizing Execution of a Contract for the Improvement of Sanitary Sewer Mains on Selby Lane between Selby Lane and El Camino Real, El Camino Real between Stockbridge Avenue and Berkshire Avenue, Berkshire Avenue between El Camino Real and Middlefield Road, and at the Intersection of Middlefield Road and Berkshire Avenue

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing Board of the Fair Oaks Sewer Maintenance District, that

WHEREAS, this Board of Supervisors did, on June 8, 2004, adopt Resolution No. 66660, which resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for the sealed proposals for the Improvement of Sanitary Sewer Mains on Selby Lane between Selby Lane and El Camino Real, El Camino Real between Stockbridge Avenue and Berkshire Avenue, Berkshire Avenue between El Camino Real and Middlefield Road, and at the Intersection of Middlefield Road and Berkshire Avenue; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on July 6, 2004, open and examine all sealed proposals that were received in the specified time for the doing of the work referred to in said Resolution No. 66660; and

WHEREAS, this Board of Supervisors has caused an analysis of said proposals to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed proposals and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by JMB Construction, Inc., in the amount of One Million Three Hundred Forty-Nine Thousand Seven Hundred Seventy-Nine and 00/100 Dollars ($1,349,779.00) based on an estimate of the amount of work to be done.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

That it is to the best interest of the County of San Mateo to award the contract for the Improvement of Sanitary Sewer Mains on Selby Lane, El Camino Real, Berkshire Avenue, and Middlefield Road to:

JMB Construction, Inc.

2.

That the Fair Oaks Sewer Maintenance District shall enter into a written contract with JMB Construction, Inc., for the doing of said work as required by the plans and specifications therefor adopted and approved by this Board of Supervisors, acting on behalf of said District, as hereinbefore mentioned, said plans and specifications being on file in the office of the Director of Public Works of the County of San Mateo.

That the President of this Board of Supervisors shall be, and is hereby, authorized and directed, for and on behalf of the Fair Oaks Sewer Maintenance District, to enter into said written contract with JMB Construction, Inc., for doing of said work, as hereinbefore mentioned and to receive and approve the Faithful Performance Surety Bond and the Labor and Material Surety Bond required to be posted by the said Contractor with the County of San Mateo in connection therewith.

That all payments to the Contractor be in accordance with the plans, specifications, and other contract documents, based on the Director of Public Works’ written estimates of work actually done.

That, Paragraph 4 above notwithstanding, aggregate payment to Contractor shall not exceed the sum of One Million Four Hundred Eighty-Five Thousand and 00/100 Dollars ($1,485,000.00) without this Board’s prior approval.

6.

That the Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
