Resolution Authorizing the Use of County Forces to Construct the Colma Creek Habitat Mitigation Project - South San Francisco Area
(County Project No. FCA07 – F149 [9R1])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, acting as the governing board of the San Mateo County Flood Control District (Flood Control District), that

 

WHEREAS, this Board of Supervisors did, on June 8, 2004, adopt Resolution No. 66727, which resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for sealed proposals for the Colma Creek Habitat Mitigation Project (Project); and

 

WHEREAS, the Clerk of this Board of Supervisors did not receive any sealed proposals for the doing of the work referred to in said Resolution No. 66727 on July 19, 2004; and

 

WHEREAS, Section 22038 of the Public Contract Code provides that a public agency may decide to have a project performed by the employees of the public agency by force account or by negotiated contracts with contractors if no bids are received through the bidding procedures; and

 

WHEREAS, the Director of Public Works has recommended that the aforesaid Project be constructed by Public Works’ staff or independent contractors; and

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

It is to the best interest of the County to have the Project go forward this calendar year.

 

2.

The Director of Public Works is hereby authorized to have the work on the Project performed by the employees of the County by force account or by negotiated contracts with contractors as no bids were received through the bidding procedures.

 

3.

The Director of Public Works is hereby authorized to pay for said work with funds of the Colma Creek Flood Control Zone of the San Mateo County Flood Control District.
