Rejection of Bid and Authorization to Construct the Memorial Park Electrical Distribution System Upgrades and Restroom Replacement Project by Force Account – Loma Mar Area

 

Recommendation

Adopt a resolution rejecting the one bid received for the Memorial Park Electrical Distribution System Upgrades and Restroom Replacement Project and authorizing the Director of Public Works to have the referenced work done by force account (4/5ths vote required).

 

Previous Board Action

Adopted Resolution No. 066839 on July 27, 2004, adopting plans and specifications, determining prevailing wage scales, and calling for sealed proposals for the above referenced project.

Only one bid was received for the work which is $38,075 (7%) over the Engineer’s Estimate.

Ø

Section 22038 of the Public Contract Code provides that a public agency may reject any bids received for a project, and by 4/5ths vote of the legislative body may declare that the work can be done more economically by the employees of the public agency and have the work done by force account.

 

Discussion

On August 17, 2004, bids were accepted for this project and subsequently referred to this office for checking and recommendation. The bids have been checked and the bid of:

San Leandro, CA 94577

 

at $569,075 was the only bid received, and as stated in the Key Facts section of this report, was $38,075 (7%) over the Engineers Estimate of $531,000.

 

The Construction Services Division of Public Works reviewed the plans and has given a firm estimate for the work of $472,807. We conferred with the Environmental Services Agency and both the Director of the Agency and the Parks Director agree that work should proceed using County forces in order to complete this necessary work using the available funding.

 

Vision Alignment

We believe our recommendation is consistent with Goal Number 7, “maintain and enhance the public safety of all residents and visitors,” of the Shared Vision Commitment to “ensure basic health and safety for all,” as the project is part of an overall program to maintain park facilities for the benefit of the public.

 

Fiscal Impact

The total estimated cost of construction and contingencies is $520,000 which includes a ten percent (10%) contingency ($47,193) as the price provided by Construction Services is based on a unit price basis (i.e., per linear foot for conduit, per cubic yard for concrete encasement, etc.). The contingency is used to pay for any additional material placed for the various bid items based on the actual quantities used to complete the project.

An appropriation in the Capital Projects Fund for the project will be included in the September budget revision.

 

There is no impact to the General Fund.

 

A form of resolution has been approved by County Counsel and a copy of this report has been sent to Columbia Electric as provided by Section 22038 et. seq. of the Public Contract Code.
