Resolution Rejecting the One Bid Received and Authorizing the Construction of the Memorial Park Electrical Distribution System Upgrades and Restroom Replacement Project by Force Account

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors, on July 27, 2004, adopted Resolution No. 066839, which Resolution adopted the plans and approved the specifications, determined the prevailing wage scales and called for sealed proposals for the Memorial Park Electrical Distribution System Upgrades and Restroom Replacement Project; and

WHEREAS, the Clerk of this Board did, in public on August 17, 2004, at 2:30 p.m., open and examine the one sealed proposal that was received in the specified time for doing the work referred to in said Resolution No. 066839; and

WHEREAS, the one bid received from Columbia Electric, Inc., at $569,075 is $38,075 higher that the Engineer’s Estimate of $531,000 for doing said work; and

WHEREAS, Section 22038 of the Public Contract Code provides that a public agency may reject any bids received for a project, and by 4/5ths vote of the legislative body may declare that the work can be done more economically by the employees of the public agency and have the work done by force account; and

WHEREAS, the Director of Public Works has recommended that the one bid received be rejected and that the aforesaid Project be constructed by force account; and

WHEREAS, this Board has considered the recommendation of the Director of Public Works.

NOW, THEREFORE, IT IS HEREBY DETERMINED THAT THIS BOARD:

1.

rejects the one bid submitted for the Memorial Park Electrical Distribution System Upgrades and Restroom Replacement Project by the Columbia Electric Company, Inc.; and

2.

authorizes the Director of Public Works to have the work on the aforesaid Project performed by force account as provided by Section 22038 et. seq. of the Public Contract Code.
